I am also sure that the Counter Argument would be that OEMs didn't need to wait until the Deadline to File. And that they could have filed earlier which would have given the FDA more processing time. Even though the FDA's issuance of PMTA "Guidance" was Sketchy and Not Very Timely.

Yes, judicial deference to the FDA *except* in the case that set the PMTA deadline to May 2020 (pushed to Sept 2020 due to COVID).

This is an argument that makes sense on the surface. You’re right that there was no guidance. The FDA and the industry were unprepared, because the deadline for filing was supposed to be 2022. Although the FDA was already a decade past their initial deadline for guidance to be issued.

The guidance they did finally give was issued not long before the deadline. The filing was huge and time consuming. It makes no sense to prepare a filing that was likely to be all wrong.

Since then, some OEM’s who filed their PMTA’s were being asked to redo large portions of the filing because the FDA changed their data templates after the deadline.

I know this isn’t a PMTA thread, but I did want to address that last thing.

I could see the USPS pushing out a Final Rule publication another 30 or 45 Days.

But I would be Very Surprised if the File Rule wasn't issued until September.

Not sure what that means. PMTAs are already required for legal sales of all tobacco products not on the market before 2/15/2007. Nothing really to postpone on that front as far as I can see. Perhaps this was old news from 2020, when the deadline was postponed from march to sept due to covid?

Where did you get that info? Far as I can see that freeman article is merely stating what MJBizDaily's article states, but no mention of postponing ban until Sept. No date given, just that ban will be effective immediately when the final rule is published.

I got that too, then I refreshed the page and it was gone. In fact, every time I refresh the page I get a new latest post and they are all from 2020. I don't understand the Facebook thing I guess.

Honestly they are messed up IMHO it's also says PACT law taxes included in price...??? WTH How do they know what my state vape taxes are if any... plus no adult signature free shipping? Shipping to states that prohibit it.... Something stinks big time here... Or am I misunderstanding something?

From the article I quote the following:

Some vaping-related symptoms they've seen included shortness of breath, collapsed lungs, holes in lungs and portions of lungs needing to be removed. In some cases, transplants were necessary.

Doctors urged Cornyn to take his efforts against e-cigarettes a step further and called vaping an "epidemic."

So the Senator became an parking lot scientist because of what he was told.

Clearly people having there lungs removed is serious and Cornyn is an idiot.
It was something in the vape that caused these diseases. I said it 6 years ago here. The logical suspect is Rayon.
