There is an issue that all these state bans run into when they start talking about internet sales. That's federal territory and falls under interstate commerce controls. As I understand it, a state can ban people from selling inside a state, but can't stop people from buying outside the state or online. Further...a business located inside a ban state is prohibited from selling to it's own people...but can sell out of state. This sort of bizarre situation occurs with fireworks. For example...it is illegal to sell fireworks in PA to PA citizens...but perfectly legal to sell them to out of state residents. Neighboring states have similar laws, so you have this stupid situation where PA residents go to other states to buy...and other states' residents come here to buy them.

Now I could be wrong....but one thing is certain...the feds will have a say on anything involving interstate commerce....

I have a question for all the legal eagles....

All of these states attempting bans go after the sale of the stuff. None have tried to outlaw actual possession. This is good, of course...but curious as to why they haven't tried it yet? Do they run into legal trouble if they shoot for that?

No legal expert here but I'll take a stab... enforcement. Other than PV's, other forms of smokeless tobacco products have no obvious way to observe usage, and we can stealth vape. Were it banned, without witnessing posession or usage, enforcement would have no reasonable cause for action.

Consider also the burden it'd place on enforcement agencies, and the NY Police Department's recent reply regarding NY's smoking ban. Liberals here in WA state want to legalize ......... for similar reasons, enforcement clogs up the system... that and they want to be able to tax it. Considering the current tax rates on analogs, imagine the rates on ........ products. :facepalm:

The answer to maxx's inquiry is that legislation to ban possession of e-cigs will be introduced only several years after the enactment of an unenforcable e-cig sales ban creates a huge black market. That's what happened with ......., alcohol and .......... The best way to prevent the introduction of e-cig possession ban legislation is to defeat ALL legislation that would ban e-cig sales.

The major thing I don't understand about this whole thing is calling it an ecig and what happens once we take Nicotine out of the Ecig and equation all together, does it then become a personal vaporizer and can the Gov't tell us what we can and can't put into our mouth next ? Ya know, when its real cold outside and I take a big breath of fresh air and blow it out isn't that vapor doesn't everyone do this ? is that going to be illegal next, pretty soon where going to have to get the OK to breath and then have to pay tax on that too.! I know I know it's a bit different but you get the point.!

This guy's a (R). Can't people shame him about the "nanny state" thing?
Big Pharma's contributed 22%+ of his "pie" the last 2 cycles. The largest single chunk in 2010 of came from Big Pharma.
Pfizer's a major contributor, 4%+ of the total "pie". Pfizer makes Chantix.

Got anything specific in mind? It takes a lot to shame a ......

Yes it is a Mormon state and the vast majority of our government are also members of the church. Therefore their personal religious beliefs spill over to the laws. However on the caffeine, they are against HOT caffeine but not all caffeine. So no coffee but they do drink coke and pepsi. What's funny is you get these guys away from their wards (churches) and members of said, then they will be as 'sinful' as the rest of us. I can't tell you how many I have been with that will drink, smoke and even participate in really 'naughty' parties. What's also the most ironic is the state owns and runs all liquor stores in the state yet the state is run by 'good' church going members who are strongly against alcohol too.

But this is what I was told was the reason it is taking CASAA so long to organize as they have to word everything in such a manner to fight the fight without insulting the religious beliefs.

If this thread is going to turn into remarks about ones religious beliefs, then move it to the religion area, or close it.

they are pretty much trying that already.....carbon credits......we exhale the exact thing they are wanting these for!!!

My prayers are with you in Utah....fight the good fight....I'm waiting for the hot and heavy here in Ohio...just down the pike I'm afraid.
