If the FDA decides to apply all sections of the
tobacco act to e-cigarettes, there are only a handful of players that will have the expertise and the funding to comply with the exhaustive rules the FDA has set for new product introduction, manufacturing standards, etc. To put it simply, the more cumbersome and strict the FDA makes the rules that apply to e-cigarettes, the bigger the chance that the FDA will be handing the entire industry over to
tobacco companies.
E-cigarettes contain no
tobacco. Those with no nicotine are not even "derived from" tobacco. E-cigarettes do not carry the same health risks as tobacco cigarettes. Therefore, it is a very bad idea to apply the same rules to a low-risk product.
