True. But the development of products themselves, if conducted overseas, are not affected by these regs. As a large majority of our hardware originates overseas, those folks can go right on making new models and adding new features, even if they cannot bring those items to retail in the US.

Relying solely on third party juice, even bought at wholesale, and hardware sales will likely not supply a sufficient profit margin for a B&M vape product only retailer to survive.

A 30ml bottle of juice costs between $ 1.50 to $ 2.50 to produce ( depending on the quality of the label used and whether it's in a glass or plastic bottle ). They are sold to retailers for $ 6 to $ 10 and are sold at retail for $ 18 to $ 25 . So yes there is a higher profit margin for house made juice, but plenty ( majority ? ) of B&M's have survived without a house made juice. Most of the B&M's i have frequented do not have a house made juice.
Do you mean August 2016, or August 2018. If the latter, almost all will be out of business unless we have a significant victory in congress or the courts. If you mean Aug 2016, my prediction is the majority will still be in business, although ordering may be a little more difficult due to the age verification process. The more significant date will be December 2016 and February and August 2017, the date some of the other requirements kick in, including registration, product listing and ingredient listing. Many vendors will not be able to negotiate these hurdles imo ( FDA's main goal ), but the the larger , more prepared ones will.I understand that come August, many small or medium size companies will fold due to the new regulations. Maybe it's a geographic thing. The B&M's i have visited have been in NYC and Seattle and all have had a large inventory of premium juice. Some had their own house juice as well, but the majority didn't.I just moved to Austin from San Jose and I've been to about ten vape shops here and almost every single shop I've been to has ONLY house juice, a few have 1-3 premiums. House juices mostly suck and are far from sanitary due to them being made right out on the counter near where you sit at the counter.![]()

Absolutely correct. Which will really hurt US retailers. However, while it will be more difficult than the current environment, I can imagine many ways individuals will circumvent that limitation, just as citizens of other countries with vaping bans in place do now.
Remember, in that entire deeming document, none of it regulates your individual use or ownership rights to this stuff. Not to say that can't happen at some later time, but for now, if I came back from an overseas visit with some vape gear as my personal property, I'd be perfectly fine going through customs.
As for having items shipped to you rather than brought, and where there might be more scrutiny on arrival, I would take my chances on it not being seized. There is such a tremendous volume of stuff shipped into the US now that catching every FT package with vape gear and not some other electronic device will be a real hurdle with current screening methods and staffing.
Are vapers going to be hurt? Yes. But retail vape businesses, at this point, look to be devastated. That's a real shame.
I've read about the gift certificates that can be purchased at Fasttech. Even if we can no longer purchase "tobacco products" via CC or PayPal, unless they start banning particular vendors (is that a possibility?), as long as gift certificates are made available, we may still be okay.The FDA can Not stop all products from coming into the USA. Nor can CC/PayPal restrict 100% of the "Tobacco Products" sales as deemed by the FDA.
But they Both can put a Significant Dent in the e-Cigarette Market. And Significant may be an Understatement.
I feel sorry for Future and or Unaware Vapers. Because life for them will be Nowhere Near what it has been for Us.

The state taxation schemes and internet sales ban etc... will not pass by Aug 2016.It will be Very Interesting to see Who absorbs a $2.87 Equivalent Tax per pack if/when the pending CA Ballot Initiative is Passed.

Of course, but they all had legislation passed or amended prior to the deemings being published. There were Casaa calls to action etc... Indiana, Utah and Arkansas, as far as i am aware for internet sales ban. Which states tax eliquid currently ? I know there are a couple, but do you know which ?
