Will Deeming Regs Shut Down the Classifieds?

Something that I've been wondering about for a couple of days now is how the upcoming deeming regs will affect the Classifieds here on ECF. Will it still be ok for us to sell mods as private sellers? Or is that covered under the deeming regs as well?

My reading is that the scope of the regulations, which address the "marketing" of products, does not include the private sale of items purchased for personal use prior to the deadline. Moreover, ECF is technically not based in the US and thus not obligated to comply in any case.

That said, IANAL, and ECF may very well decide to take an over-cautious approach.
