I should be clear that I'm *not* accusing any of the reputable suppliers here of shenanigans. I do, however, find something a little suspect about the uncorroborated "OMG panic!" emails that got posted.

I'm being as sarcastic as you Strayling.
It seems that we've heard time and time again somebody crying wolf and nothing coming of it. The way that our government works, it seems that we would hear something a month or two in advance. (Remember Desert Storm and the TV coverage?)
It also seems that we have enough issues without inventing other problems!
I would bet the % of shipments seized in relation to total shipments is very small (and are probably large orders being sent to U.S. suppliers)
I searched this site, hhs.gov, and google news as well with no info other than the ECA President's video message.
While doing so, I'm sure you'd all be happy to know I signed the petition linked on ECA's website to the FDA to keep e-cigs legal!

They got my panic order. LOL Now maybe the shock is low enough that the manufactures can do extra production run to catch up oooorrrr supply and demand will take over and the prices will go up on us. Na, That is just not posable, is it? Products are suppost to get cheeper to manufacture, as qty of production increases. We sure had fun talking about it and wounding if we would have to give up and return to anologes. Hope I can find some 901 parts in the states soon.
ok guys obviously the 5th deadline has gone and no news from the FDA, but i believe that the sooner we reach the 10,000 mark on our petition the better. This is the only combined effort to do something against the FDA in the ecig industry. so lets join forces and make it count the easiest way to get thousands of people to sign up in a matter of days is to spam youtube (technically its not spamming, its just informing)
so go to youtube, and search for any video that is relevant to this petition
type in things like
-FDA
-ecig
-Ecigarette
-FDA ban
-smoke 51
-ruyan
etc etc be creative
and in the comment box type in something along these lines (copy and paste to save time)
"HEY GUYS, the government body FDA is soon banning this product in the USA unfairly, because they know that they will get less taxes from real cigarettes. this is unfair and goes against the american constitution! please please please go to Google and type in "electric cigarette petition" and click the first link. every vote counts, we have the right to quit cigarettes and save our health!!!even if your from the UK or Canada because they will copy USA. please copy and paste this//"
something along those lines, remember you cannot include links or else it wont post, so you have to say "go to google and type in electric cigarette petition" also, at the end of your post, say "please copy and paste this" so more and more people will do it.
collectively the top 10 ecig videos on youtube have more then 1.5 million views, so getting around 5 thousand people to sign the petition in a few days should be a piece of cake! lets do it.

Specificaly here is what I sent:

I had heard that a decision was to made on this on 5/5/9,
I have been searching the FDA website, and I am having great difficulty in finding any information on this.

I am primarily concerned about the legality of the following:
The ownership of this product
The use of this product
The importation of electronic cigarettes
The importation of the "E-Liquid" that is used in this product

OK I finally received an answer from the FDA. Here it is in full.

We are not aware of any ruling. The only thing on FDAs site is OASIS refusals and import alerts.
Whether a particular product is a drug (or a device) under the Federal Food, Drug, and Cosmetic Act depends on its intended use. In making that determination, the agency considers the product's label and labeling, its advertising or promotional materials, and other relevant sources. In order to make a definitive determination of the regulatory status of any product we have to evaluate the relevant information on a case by case basis.
FDA has reviewed several "electronic cigarettes" and determined that those products were making "drug" claims. We have detained and refused several such products on the grounds that they were unapproved new drugs as defined by section 201(p) of the Act (21 U.S.C. § 321(p)) requiring approval of an application filed with FDA in accordance with section 505 of the Act (21 U.S.C. § 355) to be legally marketed in the United States. Additionally, because they were drug-device combinations under 21 U.S.C. 353(g)(1), they were also adulterated devices.
We will continue to review these products on a case by case basis.

From the response you got I'm reading that the FDA is saying you cannot make quit smoking claims with these devises. Just like if I made a lotion and claimed it would cure cancer and/or didn't list all the ingredients on the label the FDA would be on my ....
So at least in that e-mail it sounds like they don't want to ban e-cig's just stop making a claim that you can quit and that it is healthier than an analog. Just like the whole cereal thing, the FDA doesn't want the health claims on the label, even though a few years ago they said it was fine.
It's early and my coffee/nic hasn't kicked in yet, maybe I'm completely misunderstanding that e-mail.
