I agree, but I don't. The change from allowing existing stock to not allowing existing stock is ridiculous and could definitely lead to trouble for some vendors. However, the law wasn't passed on June 22nd when that first letter went out stating existing stock would be okay. The law was passed January 28th and they've had six months to prepare. Yes, some could be stuck with stock that they thought was okay to sell even though it's not in compliance. Most, from what I've seen, have been scrambling to get the paperwork for the stock they have that IS in compliance. That is no ones fault but their own.

I think it's comical that the USCPSC misinterpreted the law in their June guidance letter to the industry, but guidance letters are not binding, the law is . There is no excuse for retailers to have non-compliant bottles at this date, and not to have demanded the certificates from manufacturers to prove it, way before June 2016.

The law is silent in the subject of grandfathering. A regulatory agency interpreted the law and then conveniently rescinded that interpretation at the last minute. If you do not consider that arbitrary and capricious then that is your opinion, but certainly not shared by me. This is exactly how lawlessness is conducted. IMO.

ETA:. We are expected to believe that your legal competence exceeds a room full of full time regulatory lawyers at CPSC. Sorry. Not credible. IMO of course.

Well good for Liberty Vapor they just announced opening for their 4th shop. Good people and nice shops. The original store was in Phoenixville, next was Lansdale, then West Chester and the new one is in Gilbertsville. Best wishes Liberty Vapor! :thumb:

    I know that this is long but we hope that you will give it a chance and please read the following. As many of you may have heard the FDA released their deeming regulations on e-cigarettes on May 5th, 2016 and gave electronic cigarette vendors and manufacturers until August 8th to come into compliance with several new rules (with more to follow). Unfortunately, the FDA did not give provisions for online vendors which will greatly detriment the online vaping community.

    The first (and perhaps the largest) impediment to online vendors is the FDA's expectation of all vendors to check photo I.D. of customers under the age of 27. As you know, it is impossible for anyone to truly know the age of anyone else on the internet which forces us to check photo I.D. on each customer which involves you having to send us a selfie holding up your valid, legible I.D. This can be laborious and will greatly slow down our order processing time as we try to ensure that each of you have sent an I.D. in. There are several companies that have surfaced in recent months claiming to be FDA compliant. These companies verify your age by having you enter your full legal name, birthday, and the last 4 digits of your social security number. If confirmation cannot be made of your age with that information you will still have to send in a selfie with your I.D. This poses a great security risk for the customer and there is no way for us, or for you, to vet which employee will be looking at your sensitive data from a third party verification service. The most popular of these companies also forces you, the customer, to agree to have your information stored and sold. As we also all know, when you open an account for a service all you are asked for is your name, birthday, and the last four of your social security number, and that being coupled with your Driver's License Number is beyond what we would expect or endorse anyone doing. We simply could not bear knowing that our actions have jeopardized the safety of anyone who has entrusted us with their business. This is only one of many problems with the new FDA regulations - which do not include inevitable tobacco taxes, state regulations, and enforcement by agencies such as the ATF and TTB now that we are classified as a tobacco manufacturer and reseller and the FDA has had no reservations about the seriousness of their enforcement and said, "We will hit the ground running on August 8th, 2016." Needless to say, even if we were to bring ourselves into compliance not only would your order time be greatly extended but there would have to be a price increase across the board and that is simply not fair to you after you have given us years of your loyal support.

    We could write for days and spend hours with each of you discussing everything our lawyers have informed us that the FDA will be doing starting August 8th, 2016. We are simply writing this e-mail because we feel that you have given just as much time to this industry as we have and have put an equal amount of effort into helping us succeed, so you have the right to know why we are closing. We did not say anything sooner because we feel that it would be immoral and inappropriate to release an announcement of our closing and convey the message that we are asking for you to order, that is not our intention and we hope that you do not feel pressured to order with this. However, the most important thing that we wanted to portray in this e-mail is our sincerest appreciation for your years of loyal support and patronage, helping us with your thoughts, comments and orders every step of the way. Even though we have not spoken personally to each of you, we certainly recognize every person who has placed an order and have even found ourselves reordering products and saying, "so and so really loves this flavor." We do not take responsibility for the success of Vices Electronic Cigarettes, but instead hand that over to you. Thank you.

Can't like that post, too sad, it seems like they gave it serious thought and decided it wasn't who they wanted to be and I commend that. I hate what the FDA is doing to good people.

There was a place named Gordona Vapes that has been selling e-liquid for years.
And apparently they have now stopped.

But if you go to their website, they have all of their recipes available...

AFAIK you should not be asked to provide any part of your ss#. There are plenty of places that are not asking for that info. The one and only time I was asked to prove my age I was told that they would not use my info for anything other than their use and it would remain in house and not sold. And I also told I could cover up the license number because they did not need it.
There seems to be a number of age verifying software available so anyone asking for ssn or license number, I would back out of the sale.

For those age verification services to work, they may require only the last 4 digits of your SS#, not your whole SS number.

Yeah thanks, but they should not even ask for that. If name, bd, and address doesn't do it, I fail to see what the last 4 digits is gonna do. Plus, it may or may not be illegal to ask for that type of info, but I do know that the government takes protecting individual information is high on the list.(not FDA)

Sad to see so many! I think I have the doc updated for closings but as people hear more please enter the info, I want this to be documented so we can show the effect FDA has had on our vendors, they won't be forgotten!
