I think this "Deeming" seriously has to be opposed.

It's all well and good for whatever appropriate governement bodies write appropriate regulations to regulate a new product, however, to merely create the legal fiction absurdity of "Deem"ing some new product to be the same as some older product just as a workaround way to make it legal, is just..... i dunno the words.

Maybe by next century, legislators will actually end up in jail when they come up with absurdities like that.

In a nutshell, deeming regulation means,
We want to shoot A
Because it looks like B, and we can shoot B.
So we invent a new law to make it legal to call A a type of B
So now we can shoot A

Great article.......thanks for posting.
I really like this bit

"Some activists think we ought to have zero tolerance for any behavior that resembles or reminds us of smoking. Purveyors of this militant stance are unrealistic, unpragmatic, and intolerant. This attitude is typical of abstinence-only zealots, whether the evil they perceive is smoking, premarital sex, or anything else. The zealots draft blue laws. They reduce sex ed to a joke. They call in regulators. They traffic in histrionics and paternalism."
Nice
