Are E-cig banned in the USA??

They aren't completely banned, as far as I know. However, the FDA is investigating them to determine the safety and contents/ingredients of the devices. For a while the Smoking Everywhere company had a spot in the mall here and then out of nowhere they disappeared.

There really dosen't need to be an outright ban, as far as the FDA is concerned.

The official stance of the FDA is that e-cigs are a UNAPPROVED COMBINATION DEVICE (DRUG AND DRUG DELIVERY DEVICE), and as such fall within it's regulations for such devices, and therefore CANNOT be legally sold or distributed within the USA. Doing so can lead to enforcement activities and penalties against those that try to sale or distribute them within US borders.

That's the stance of the FDA until something changes... even though I don't agree with the above decision, those that are selling or distributing such devices are at *risk* of enforcement actions, should the FDA get a wild hair up it's a** and start enforcing its' power. 8-o To an extent, it already has by seizing shipments to distributors here in the US. (At least those they can find :D)

If they were illegal, you wouldn't be able to walk into a convenience store like Pilot and buy them or refills.
I just bought an Npro and carts last week. They're sitting up there at the register in a display case right next to the cigarettes.
And if there really was such a big concern over these thing, or if people were getting sick, or had serious potential to get sick from them, they wouldn't be on the shelves all across the country. No way would they let it go. At first report, they would ave yanked them right off the shelf within 24 hours they would have been gone.

I don't know all the details of the FDA and their position on e-cigs but I really hope they don't ban them. if anything regulate them and keep them legal. They really aren't that different from the Nicotrol Inhaler. You have to have a presription for it but it still delivers nicotine to you upon inhalation. I really don't see much of a difference in that and an e-cig except the e-cig produces vapor

Chad--that is where a lot of people get confused. The FDA is charged with appoval of the sales and marketing of Food and Drugs for consumer use. They have the authority to regulate them without enacting any new laws. So it is not a question of "posturing", rather one of final authority absent court intervention as we are seeing in the SE v. FDA case.

Bad News: They had an article in the Chicago Suntimes about congress discussing banning the ecig in IL. I'm keeping up on it, and will keep everyone posted.

Good News: Just 2 days ago me and my fiance where walking past the Cig store about 2 blocks from my house and seen a huge sign in the window that said "WE NOW SELL ELECTRONIC CIGARRETES!"...

They where not selling them last week as I go in there often. I actually tried one for the first time and LOVED it!!! My lady stopped smoking just a month ago cold turkey, I enjoy the habit but am looking for an alternative to stop.

I placed my first order for e-cig last night! :)

I'm in IL too (not far from chi) and the mall near me still has a smokingeverywhere kiosk as well which is a good sign... too bad they're ripping off the masses (redistributing generic e-cigs at super high prices.) Oh and the little chick that works the kiosk has an attitude problem which can't be good for public perception of the product :nah:. :)~
