It doesn't really make sense to me that they could ban e-cigs without banning nicotine inhalers and the like. Isn't an e-cigarette just basically a more realistic, more enjoyable, and more effective nicotine inhaler?![]()
This is the catch22 to the whole problem. If the E-cig is determined to be a drug delivery device, so will anything that delivers nicotine including cigarettes. All of a sudden Big Tobacco will find that this is the wolf in sheep's clothing that has the ability to be the demise for a business that brings huge tax money to the table. As soon as the powers to be realize the implications and jeopardy to the tax revues, we will see some backpedaling to try to get out of a no win situation. The only action I can see the government taking is to tax the E-juice as a tobacco product in an attempt to keep the tobacco tax dollars flowing. I believe this will happen, enjoy the cheep juice for as long as it stays cheep.
The hardware isn't connected to tobacco and this presents an entirely different problem for the FDA and government. They would love to tax equipment as a drug delivery device, but the accusation won't float in court with big tobacco concerns that it will drag them down the same road. Government doesn't want to cut the huge tax they get from tobacco and is going to have to walk a fine line to keep everything status quo.
