all i kno is im trying to get my cancellation right now, can you imagine waiting while they wade through thousands of pre orders refunding each and every one.... unless there's just a single self destruct button :p

I had to wait 8-10 days to get a response from them, so I know how frustrating it is when you want to get something over with.

What Lotss stated could be miscommunication, at least that what I hope for ._______.

I would distribute blame a bit more evenly:

1) hana modz made a nice box, but failed to satisfy demand. They are to blame to not ramp up production for consumers and also reducing the price (which can be done with larger volume)

Sorry, no. Hana has zero -- ZERO -- blame in this situation. None of this justifies IP theft nor makes protecting Hana's IP the wrong thing to do.

Lol, we're def in for money, however, we make anywhere from 1$ per unit to .40¢ after production costs of course. We may differ from most in that we're producing 100000 units weekly. The production of those mods and the materials used do not justify 250$ imo.

Production and materials are not the only expenses a business has. And I'm pretty sure production costs a lot more than you think.

The suit is filed is STATE court. The only other companies that could be associated would necessarily have to be in CA.

No, the suit is filed in federal court.

Then how is it that they could attack Does to the suit? I'm under the understanding that you can't do that in federal court.

Either way, it does appear that Does are, in fact, individuals and not companies.

I'm still placing a metaphorical heavy bet on those Does being anyone associated with Illvapes from investors to owners to perhaps even employees (though that would be super dickish).

Well the only thing good that came out of this for me was it motivated me to buy an Evolv DNA 30 chip in anticipation of replacing what came in the clones. Well with the additional delivery delay from Cloupor and Mouser delivering my parts 9 days ahead of when they said I would receive the items I built my first mod. Working great so far. Time to test it out :) Canceled my order last night from 101vapes and received confirmation from them today. I do still hope this works out for everyone. I would still like to have one for a spare but I think I'll wait till all the drama is over and the units have some test time on them.

I SOMEWHAT disagree. While they are not obligated, the way it's being handled is simply unnecessary.... It's another small business a simple cease and desist would have prompted the same response from illvapes as suing them. While I completely agree it's their trademark and have every right to protect it, could have been handled in a better way.... I don't think suing them into bankruptcy helps anyone, except "the company that shall not be named" (let's lighten the mood a bit, eh?)... ILLvapes already is down money considering they'll have to prove where the units they possessed ended up in order to prevent further damages... That's a lesson learned, you're beating a dead horse suing them. And don't forget any publicity is good publicity, gets the name out there and yet they still cannot provide... I don't want to debate anymore just my take on the situation and how I feel about it. It's wrong we know. Cased closed.

Quick lookup shows that it is not allowed in diversity jurisdiction BUT are allowed in Fed question.

Since the suit is brought under Lanham act (USC) Does are permited

Well the only thing good that came out of this for me was it motivated me to buy an Evolv DNA 30 chip in anticipation of replacing what came in the clones. Well with the additional delivery delay from Cloupor and Mouser delivering my parts 9 days ahead of when they said I would receive the items I built my first mod. Working great so far. Time to test it out :) Canceled my order last night from 101vapes and received confirmation from them today. I do still hope this works out for everyone. I would still like to have one for a spare but I think I'll wait till all the drama is over and the units have some test time on them.

So you seriously think they would have ignored that though? I know I wouldn't have considering it was faaaaar too obvious that was their trademark.

A bunch :) I don't know exactly I spent a lot of time trying to setup my lathe as an end mill for the cut outs and cutting and threading the 510 connector etc... It was also 1000 times harder for me to solder than it was 30 yrs ago. The eyes aren't what they used to be and even through a magnifying lamp it was still pretty tough for me. Gotta respect all the folks that do it on a regular basis. It was a good experience overall. I just hope it lasts a long time. I'll be crushed if it burns up on me tomorrow. :) I'm thoroughly testing it now and all is good so far. knock on wood. :)

Hana HAS to protect their trademark if they want to keep it. If they knowingly let illvapes, and others, infringe they will lose the mark. Asking them to stop, cease and desist, will not necessarily stop them.

If I had a reputation and someone else traded on that reputation I would be ...... enough to sue them.

No matter how much it cost me to produce a product I can try to sell it for whatever I want. Hana is in business to make money for the investors and owners (and to pay the people who work there). In order to stay in business they must design new products. It cost quite a bit of money to design and build something, development costs, the clone guys don't have that.

Should Hana, who can only produce a limited quantity of mods, sell them as cheaply as they can and see the people who get them resell them for twice as much?

Here's my build.....made 10 of them so far (both dna20 and dna30's)....never sell any but give some to friends....smaller than a bic lighter and a 30 ml. bottle... takes about 6 hours to build one....counting epoxy curing time...
