Illvapes is a goner :ohmy: I wonder if they will give refunds to their customers or claim bankruptcy and keep the money and close shop :ohmy:

I ordered from Ill because it was the first place I found them and left my order there because of the supposed built in batt. Sent them a message two weeks ago that if it had no li-po batt. to change to the no logo and refund the difference or give full refund. Have not heard from them.

Hanna could agree to drop it if they would remove the logo and pay cost. It would save everyone a lot of grief and money. There is no real gain in shutting down one seller if these things are sold everywhere else with no logo anyway. I don't blame Hana for trying to do something, just hope something can be worked out.

Looks like Hanna filed for the trademark on April 19th. Would that make all sales before that ok? Anybody have any idea how this works? Don't know if they can go back or not.

They shut down flea market venders for the same thing. Next month they are back out there with a new shipment with labels cut off.

Anyway, last week I ordered a second Vapor Shark dna. Have had the first one for six months now and love it.

Doesn't matter when ordered. Nothing is set in stone and nothing changes until
(In chronological order)

- temp restraining order
- prelim injunction
- the case is settled

the first two could happen relatively soon
the latter will likely take a while should the matter not be settled

I feel bad for illvapes. Yes they jumped the gun and didn't think about repercussions of their actions. I don't think they were trying to scam people OR hurt Hana Modz. They just got excited and now they will have to go to court. AND I feel bad for all those that supported the local shop who are now rightfully concerned they will not get the product they purchased on good faith.
Every vape shop I have ever entered and spoken to the owner..They were really nice people. I hope something can save the shop and the money of folks that bought.
If they can make it right most likely they will.

Addition: if they haven't delivered yet then they technically haven't sold anything yet. So how are they going to get in trouble anyhow?
Heck if I take your money and say I'm going to sell you a stolen ring, but I never give you the stolen ring...am I selling stolen goods?

someone/anyone please educate me......

My understanding from "patents and trademarks" when it comes to china made knock offs is pretty much "hahaha good luck". My curiosity comes when it is shipped to the US. Im guessing that US vendors/distributors can not sell these because on US soil it is "copied".

I guess what I am asking is, using the "middle man"(ele8, illvapes, eciggity, etc) where it becomes illegal? AKA can we order from alibaba/fasttech and not have a problem but if we order from a US based vendor DO we have a problem?

The problem isn't the vendor you order from, its the product. When your Fasttech package comes through customs it can be randomly searched and inspected. If any items found inside infringe on US trademarks your item(s) would likely get seized.

If you do a quick google search about seized shipments you will find a slew of people talking about their fake Coach bags/football jerseys getting seized by customs.

With that said I seriously doubt customs is looking for Hana logos on your box mods.

So my final decision on this since I ordered from Suedvapes Is to give it one more day If i see no news from them on not being able to ship the no logo's..... Done deal, Ordering from Elev8. Waiting a few extra weeks is no big deal, And If i were you guys I would do the same. Lucky for me i was already sketched out from the start and ordered from the Illvapes Ebay store! Ebay's pretty good about getting money back quickly.

I also ordered from an eBay seller. I hope its just a normal person and not an actual shop so I can still get my logo version.

So anything sold, before they filed for the trade mark, cannot be delivered even though it was sold before protected law? I can see stopping sales after but not before. If that's the case should be some good money looking for things not trade marked.

Not trying to be a smarta.ss just trying to learn about the process a little.

Not to the mad stage yet. Will wait this out and see what happens. Threw away more than that on smokes. Would have bought a Hanna but not willing to put up that much to wait months to get it. This would be my first clone.

You guys need to understand that the mods were advertised as Hana Modz clones. Any vendor who did this has misused a registered trademark and sold an item through using that trademark. It doesn't matter what cloupor puts on the mod (well it does), but for legal purposes, this has caused damage to the Hana brand. They do have a legitimate case.

IMO you get what you pay for and if a US manufacturer shut this down is a victory. Get your money back and move on.
Good vape gear isn't cheap and cheap vape gear isn't good. Most of the time...pretty much all of the time.

While I do agree with you for the most part. I have seen several clones out perform originals. And I do own vape gear that is cheap and very good. But I also own more expensive items that I do love and cherish. But yes. if it doesn't go through, I'll get a refund n' spend my money elsewhere. Not a huge loss :p

From what i've seen, it was my impression that this is a lawsuit against the use of the name, not the selling of a clone or mod. So if they do go to court, they will have to pay for using that name that is trademarked. Correct me if i'm wrong, that is just what I thought. I'm no lawyer though.
