Now see we all can have civil discussions. Now to make another point, as stated earlier, I work for one of the leading flooring manufacturers in the world, based in the US. We routinely store shop and knock off competitors items, then pitch our knock off to many very large US retailers. This is routinely done to us by the competition. No body sues us or them. However, if they used our logos that would be a different scenario. We cannot breach a patent, however we can legally get darn close. I would think this applies to mods. I do and always have disapproved of using logos on any clones.

Adding my opinion on who is at fault.... I feel sorry for illvapes too and Curlyx... made some good points....

My opinion is that this whole thing could have been avoided and I place the blame solely on China.... They built and advertised the clone to take advantage of an American companies success. They specifically made it as close to an exact copy as they could (and are copying other popular American mods as clones as I type). Vendors here not being knowlegable enough about Trademark issues decided to pre-order and also take advantage of the Hana's popularity and lack of being able to meet demand and offered a clone at a fraction of the cost. This placed the vendors in the position whereby US laws apply to them while China sets back and rakes in the dollars. Since all this happened China is revisiting its clone by removing the hana logo, removing the hologram stickers, and etc. And Hana was put in a position I'm sure they did not like or want to be in. This caused them to have to make a business decision. Hana has legal rights also which they chose to exercise.

Bottom line opinion from me is that China is to blame and as long as we allow it to happend it will continue...Clones also can put American companies like Hana out of business. China's economy is built around cheap labor, sweat shops, and etc. Our economy is not. "Cheap" costs American's jobs IMO. I'm not defending the vendors or Hana as both were put in a position neither IMO wanted to be in and I lay the blame squarely on China....

And that's my 2-cents to add to all the other opinions....he-he.... my opinion and 2 bucks will buy a cup of coffee just like others opinion will :):)

US PC manufacturing died and took a lot of good jobs with it; that was not a good thing by any means. This is the ultimate end of allowing markets to be distorted by global outsourcing.

Outsourcing is NOT distortion of the market. It's the market doing what the market does which is get you a particular product at a price point the buyer is willing to pay. Trying to make and enforce laws which favor US manufacturing is distortion. If US manufacturers want business, they'll have to make products at a price people are willing to pay. If they can't do that, it isn't my problem. This is the problem when you have a "planned" economy with things like minimum wage. Those are the real distortions in the market.

I think we've all heard of the problems. Those are the people who come to this thread to make sure we all hear it. OTOH, mine was flawless. Happy to have paid full price for it, and in my mind it was worth every penny.

IMO opinion the HANA Modz company is all about the money. At one point I really wanted the authentic. My view of them has dramatically changed with all the run around they gave their customers. I mean come on, how hard is it to increase production to meet demand. Their QC obviously sucks. I've heard of so many ppl waiting months on a 250$ mod just to get a DOA mod or some other quality issues. For 250$ a mod better be top notch, not half a**ed. Imo opinion they kinda deserve the grief they are getting. I own 2 ProVaris and paid a pretty penny for both, this why I don't understand ... is up with HANA. I work in production for a very large US flooring manufacturer. I have to deal with raw material venders quite often. It is known, in my industry, that certain suppliers that are the sole producers of certain items create shortages on purposes to drive up cost of materials. I've wondered if this may have been a trick that HANA was trying to pull only to get bit in the a**. Just my thoughts on what's going on.

i just sent an email to cancel my order, did they send you that confirmation because there refunding everyone or was a cancellation you made? like is everyone getting that email?

He asked for my order number. I replied. Then he emailed me to say it is canceled. Shortly after that I got a confirmation email

I would distribute blame a bit more evenly:

1) Hana Modz made a nice box, but failed to satisfy demand. They are to blame to not ramp up production for consumers and also reducing the price (which can be done with larger volume)

2) Cloupor and other cloners, who think that names and logos matter. So they try to copy exactly. Completely unnecessary as well, since they could have made a similar box mod without infringing.

3) Illvapes for thinking they get a better sale if they use the Hana name.

4) Consumers who just see price as the only relevant factor.

Crazy thing is in February I ordered a Hana from a vendor that wasn't able to commit to their promises. So ordered a unit from ILL March. Found out the lipo wasn't included so I canceled. ordered a no logo in April. And now am getting that refund. Ordered a unit from elev8 on Monday. It just goes on and on LOL

I think it's commendable that many people have the luxury of working for a non-profit. Most companies, however (mine included), are in business to make money.

Lol, we're def in for money, however, we make anywhere from 1$ per unit to .40¢ after production costs of course. We may differ from most in that we're producing 100000 units weekly. The production of those mods and the materials used do not justify 250$ imo.

"does 1-10" stands for the other vendors/companies that can still be added to the lawsuit, as of right now its only illvapes but 10 other companies can still be added

The suit is filed is STATE court. The only other companies that could be associated would necessarily have to be in CA.

I'd bet that those "Does" are all associated with Illvapes as they are the only ones I know of that had the Hana logo model.

Curious...what do you sell and do you sell directly to the consumer?

I actually think we agree on something for once! We'll done Armadillo!

I am fine with clones that are marketed as such. No logo or trademarks. We all buy them!! How many here go to target and walmart and buy "their" brand that is so similar? That cereal box with the bunny on it and it's called "Tricks". But those fake replicas of stuff that are SOLD as the same thing piss me off!!
