Bartender Says Its Against the Law

Had a b-day party for husband at a bar when bartender saw e-cig said can't smoke it in here against the law. Tried to explain it but to no avail, rather than cause problem let it go went outside. There was another e-cig smoker in our group. I would have pushed it and told them to call police but didn't want to disrupt the party.

You guys really need to give this bartender a break! Incompetent? This is a NEW technology, and it looks exactly like a cigarette (or close). How is he supposed to understand when he has obviously never seen this before? I'm on his side, and you should have definitely asked for his permission first or told him beforehand, so you would have had a chance to explain; instead of looking like a deviant.

He decided to err in favor of the law.

Can't rightly blame him.

Then you have to consider that even if he was convinced that what you were doing was legal, he'd probably have to field complaints all night from patrons who thought you were smoking. God help him if someone decided to lodge a complaint against him.

Who needs the hassle?

And what do you think they would have done? Made the bartender allow you to vape inside? I believe establishment owners (or employees) have the right to disallow vaping in their business. You might stand a better chance trying to convince the actual owner of its merit and having him make a rule to allow it in his business, rather than involving the police.

AN ACT concerning public health.

Be it enacted by the People of the State of Illinois,
represented in the General Assembly:


"Smoke" or "smoking" means the carrying, smoking, burning,

inhaling, or exhaling of any kind of lighted pipe, cigar,
cigarette, hookah, weed, herbs, or any other lighted smoking
equipment.
"State agency" has the meaning formerly ascribed to it in
subsection (a) of Section 3 of the Illinois Purchasing Act (now
repealed).
"Unit of local government" has the meaning ascribed to it
in Section 1 of Article VII of the Illinois Constitution of
1970.

I have one restaurant owner who is worried about the "old people" complaining
so I let it go. All the other places were cool about it and I've also sold six m401's to people. The police chief and clerk bought one and love em.

I wish people would stop trying the public's patience by smoking e-cigs in non-smoking areas. It is NOT THE MAIN BENEFIT OF THESE THINGS. It drives me insane when I see promo material saying "It gets around smoking bans!". So what??? Is that why we are using them? No. We are using them because we think they are 100 times safer than cigarettes not because we can act like smart-arses and smoke in public indoor places.

Using them indoors is rude in my view as is arguing excessively with people who try to stop you. Just go out to the smoking area and do it there. The e-cig battle is easier to win without all this aggro over smoking indoors.

I've vaped in public places but very discreetly.....that's what I do at work too. Why? Because if one person complains, then you're done. You will be the one asked to stop....not them. So I'd rather vape discreetly all night rather than be noticed and asked to go outside with it. A restroom stall also makes a nice discreet vaping area, and you can still stay inside :p

While outside I showed it off to a bunch of smokers leaving the girl I was on a date with sitting at the bar by herself for like 10 mins.

Was she there when you got back.:D

Reminds me of playing fooseball with the guys all night. Of course way back then, we had ash trays built into the tables.:rolleyes:

If you pushed it, you would have gone to jail or fined. Just because they're legal, doesn't mean you can vape anywhere you please.

Jim Davis is correct. That bartender, with the owner's permission, could have you tossed on your e-.... in an instant if you fail to comply with his order/request. You are on private property and your conduct must conform to the rules of the owner or establishment. Bluntly, there is no such thing as a "right to vape." You do so only with permissions from others when on their property.
