I agree the first bill is something I would like to see. If the antis don't want children vaping, then it should be illegal to sell to children, but that's as far as it needs to go. Leave the flavors alone and leave the ecigs, snuff, etc for adult smokers.

Nicotine kills? No it doesn't. Cigarette smoke kills, but it isn't the nicotine that's doing the killing.

    Standard-Examiner (standard.net) Feb 2 2010:
salt LAKE CITY-- A Utah House committee decided on Tuesday to ban electronic cigarettes and most other smokeless nicotine products.
Rep. Paul Ray, R-Clinton, introduced a newly modified bill in the committee that banned in Utah both candy-like products with nicotine and e-cigarettes, a nicotine product that is inhaled with vapor.
The new decision by the house committee was to add e-cigarettes to the ban list but exempt snuff.
[...] The Ray proposal now moves to the full House for a vote.

    I posted a comment:

John Charity Spring said: "The legislature should be applauded for taking a stand on this important community safety issue."

Yes, but they took the WRONG stand. They banned a safer alternative to tobacco smoking and left the more dangerous product on the market. What sense does that make?

Casey said: "The bill allows the use of e-cigarettes as soon as the FDA deems that they are a safe and effective stop-smoking tool (like patches)."

The FDA is currently involved in a lawsuit where the judge has deemed that the devices are "reduced harm tobacco products" and NOT smoking cessation devices. What if the FDA never gets jurisdiction?

Support the ban said: "Thank you to our legislators who care about the HEALTH of Utahns by banning these products including e-cigs."

If they really cared about the health of Utah's smokers, they would let them escape the thousands of toxins and hundreds of carcinogens in tobacco smoke by using e-cigarettes, which only have nicotine, propylene glycol and flavor. It makes no sense at all - they are condemning people who have quit smoking! See casaa.org and educate yourselves on reduced harm alternatives!

Any CASAA members in Utah?? We'll help you get a letter writing campaign started to get this overturned!!

Here are the sites for tracking Utah bills HB88 and HB71 Second Substitute, respectively:
    H.B. 88 Bill Documents - 2010 General Session
H.B. 71 Second Substitute Bill Documents - 2010 General Session

There are two bills under consideration:
1st is bill HB88 „Electronic Cigarettes Restrictions“ (Ronda Rudd Menlove)
2nd but far more important is bill HB71 S02 „Nicotine Product Restrictions“ (Paul Ray)

HB88 would outlaw e-cig sale to minors. It would also require direct, face-to-face sale of e-cigarettes.
    HB88 passed House Committe (1/29/2010, votes: 7 - 0 - 0) and House 3rd reading (2/4/2010, votes: 70 - 0 - 5), and is now up to Senate.

The critical bill HB71 S02 would ban the sale of e-cigarettes (and other smokeless nicotine products), period.
HB71 S02 passed House Committe (2/2/2010, votes: 6 - 1 - 0, note that the opposing Phil Riesen, D-Holladay is actually the only potential ally) and awaits House 3rd reading.

    Subject: HB0071-S02

    Text:

MY STORY: I am 64 years old. I smoked for 45 of those years. Products and methods that I used over the years in unsuccessful quitting attempts include FDA-approved nicotine patches, gum, lozenges, and nasal inhaler; Bupropion; American Lung Association smoking cessation class; Nicotine Anonymous; and hypnosis. The problem underlying these multiple failures is the fact that nicotine abstinence triggers memory, attention, and mood impairments that persist until I resume taking in adequate amounts of nicotine. Obviously, medicinal nicotine provides inadequate amounts.

I used to lie in bed at night, being kept awake by my wheezing and pray that God would send me something that would allow me to stop smoking without forcing me to sacrifice my cognitive and emotional health. E-cigarettes were the answer to that prayer.

On March 27, 2009 I began using an electronic cigarette and stopped inhaling the thousands of toxins and carcinogens in tobacco smoke. The wheezing is gone. I no longer cough up a nasty chunk of phlegm in the morning. I can laugh out loud without triggering a coughing jag. My BP is down and so is my cholesterol.

Tell me please, why do you want to "fix" this situation for me? Why do you want to "protect" e-cigarette users by forcing them to resume tobacco smoking? Why do you want to "protect" continuing smokers from the most effective quitting method the world has ever seen?

"Rep. Phil Riesen, D-Holladay, asked for bills that go further than the original two. "Setting aside children, we need to figure out a way to get nicotine products out of the hands of adults, because it's going to kill you." "

Is this guy a TOTAL imbecile? I guess he must be. Then I guess in a way, if he was talking about analogs, I'd completely agree. Otherwise--- this guy needs to be doing a "facepalm"

Here is what I have sent to that list!

I have been Tobacco free now for 6 months thanks to Electronic Cigarettes (Personal Vaporizer)

I was a 1.5 pack of cigarettes a day smoker, walking up a flight of stairs would tire me out. I have tried numerous quit smoking aids from patches to prescription medications. Never success and often upon returning to smoking I smoked more than prior to quitting! My teeth have yellowed, my clothes, car and home smell. Smoking is a bad habit yet accepted by the FDA. However, with technological advances, smoking has been taken to a new level. Technology has given us the Personal Vaporizer! The Personal Vaporizer has reduced the smoking bad habit risks to new all time lows! It has rid our habit from Tar and Carbon Monoxide, our lung capacity has increased, no more bad oders, teeth color improvements, no toxic second hand smoke and we can walk up that flight of stairs again! The list goes on!

Smokers will continue to smoke, intelligent and educated people will Vape! ( Vape - the use of personal vaporizers )

Please let intelligent people make intelligent decisions and join us in making the most intelligent decision of all - vote against HB71 S02!

    My new Saying!

Smokers will continue to smoke, intelligent and educated people will Vape!

has nothing to do with health, or the government's supposed "concern" for the well-being of americans. cigarette taxes are a big fat wad of cash. i have ordered kits, cartos, and juice 5 times from the internet and havent even paid sales tax yet. have to imagine how much money we cost the government every day by trying to not die of lung cancer with the legal, but regulated, and of course taxed, sale of tobacco.

no, he is a cheap demogogue. he is typical of government officials in our system, he knows nothing other than what he wants to know, and what his handlers think his constituents want to hear. like every other politician in the history of the world, if he was a tree and a populist wind blows past his leaves would rustle.

it is just a new generation reaction to the old buggy whip problem. when cars were invented, the question was posed, that if horses arent needed, what happens to the poor fellows who make buggy whips? well, the problem here is that the buggy whip makers, i.e. the big tobacco companies, are already in bed with the government, so any threat to them costs the government money. but i guess saying that here would be preaching to the choir. i dont care if they tax the crap out of the e-cig business, which they will, i wont pay some rich idiot from RJR for my own death. they already took enough of my family from me. screw them

Here is what I just sent to every person on the list:

I implore you to oppose HB0071-S02, which would make electronic cigarettes illegal.

    Here's my story:

I was a smoker for 21 years -- half my life. I tried quitting multiple times, both with all of the available NRTs (lozenges, gum, patches, and so on) and cold turkey. I failed every time.

In recent years, I had been experiencing health issues common to long-term smokers. I could no longer walk up a single flight of stairs or take a brisk walk without becoming breathless. When trying to breathe deeply, I felt as if someone were sitting on my chest. I was having coughing fits. My blood pressure was up.

Then I discovered the electronic cigarette, and my life changed.

I smoked my last traditional cigarette 3 days after purchasing my first electronic cigarette. That was over 8 months ago. Based on my previous smoking habits, this equates to almost 10,500 traditional tobacco cigarettes that I have avoided.

I can now easily take four flights of stairs without exertion. I now take long, daily walks that both my dogs and I enjoy immensely. I can breathe deeply again and actually enjoy the feeling of my lungs fully expanding with clean air. I had almost forgotten what that feels like. And my blood pressure is down.

These devices, I am convinced, have saved my life. They are the only things that continue to successfully keep me away from smoking traditional cigarettes. But if they were to be taken away, I would most likely return to smoking. And many others who have successfully quit using electronic cigarettes would do the same.

Is that really something you would want to happen? Really?

    Thank you for listening.
