In a mostly (but not totally) partisan vote.

Thankfully, just like most such bills coming out of the house, it is unlikely to get any consideration at all in the Senate.

Judge Paul Grimm's court ruling ordering FDA to begin enforcing the 2016 Deeming Rule (which bans the sale of >99.9% of nicotine vapor products now on the US market) on May 12, 2020 that is going to ban the sale of virtually all nicotine vapor products in the US.

HR 2330 would have:
- banned menthol cigarettes and flavored cigars, smokeless tobacco and pipe tobacco,
- required a Clinical Trial for all flavored vape PMTAs finding it significantly increases smoking cessation,
- banned Internet and other non face-to-face sales for FDA approved tobacco and vapor products,
- imposed FDA fees on FDA approved vapor manufacturers and raised other fees to raise revenue for FDA,
- redefined synthetic nicotine as a tobacco product subject to TCA and Deeming Rule,
- exempted premium cigars from complying with FDA Deeming Rule’s PMTA requirements,
- extended FTC tobacco advertising restrictions to FDA approved vapor products, and
- increased penalties for selling FDA approved tobacco or vapor products to minors,

HR 4742, which was amended to HR 2330, would have taxed nicotine in vape products at the same rate as far more harmful cigarettes: $50.33/1,810mg or $.0278/mg of nicotine, which would have taxed each 50mg nicotine vapor pod at $1.40 ($.02678x50mg=$1.40), each 100ml bottle of 3mg/ml nicotine e-liquid at $8.03 ($.02678x6mgx100ml=$16.07), and each 100ml bottle of 6mg/ml nicotine e-liquid at $16.06.

HR 2330 is DOA in the Senate, but will likely be reintroduced by House Democrats next year (in the next Congress).

The good news (in my opinion) about the Deeming Rule's nicotine vapor sales ban on May 12, 2020 is that FDA is unlikely to begin enforcing it against the vast majority of manufacturers until after November's election.

Regardless, nicotine vapor manufacturers (that aren't submitting PMTAs), vape shops and other retailers should begin announcing "FDA vapor prohibition sales" alerting customers about the May 12 FDA sales ban, and urging customers to stock up "before its too late". Note that sales of alcohol skyrocketed during the months just before Alcohol Prohibition became federal law 100 years ago.
