After watching the clip on the Long Island ban I thought a thread like this make be useful.

Basically some ideas for people using OEM packaging

1. Dont use cartoon characters on packaging, websites or handouts
2. Avoid terms like "Ultra-Light", "Full Flavored" and "Smooth taste"
3. Avoid overly flashy packaging ( remember kids like shiny things)
4. Include a statement that they are not FDA approved on the outside of the packaging
5. Have 18+ stamped on the outside of the packaging.

I'm really glad to see suppliers come together in this manner - says a lot. And... The ECA is looking better and better all the time. Great job guys :)

The majority of the suppliers I know are stand up people and we are united out of necessity, after all we are all in this together, and we too are e-smokers...

The problem is there are too many people wanting to capitalize on this market and they'll tell you anything to sell you one. I've tried to be as honest as possible on our website.

I'm a little irritated with some of the vendor sites I've seen with women and men smoking e-cigarettes like they are a fashion statement as well. Stop glamorizing it! Ya'll know who ya are!

I think one of the beautiful things about us all (at least up on ECF) being fairly small businesses, is that we have the ability to control our messages and control our packaging. In order for us small guys to survive, we HAVE to stick together and we have to prove that this isn't just about a quick buck.

Many of us are ex-smokers and we know how we became smokers. We can sympathize with some of the anti-smoking campaigns points because once you pull off the propaganda shroud, many a message is a reasonable message.

By taking the initiative now, allows us a better footing when and if it does come down to some sunny day when the FDA draws a line in the sand and those who have taken the initiative are on the surviving side of that line.

Packaging should be straight forward. Include the points that BG touched on and I would also like to include:

6. Ingredients list for all liquids and cartridges. (especially considering that both the PG and the VG can result in allergic reactions to certain people)
7. Warning labels noting the harm to children and pets specifically.

All of Bloog's new cartridge packaging that was just printed now contains the following warnings:


The Bloog is intended for use by those above the legal smoking age. What about HTS Tariff codes? Nicotine importing. Flavoring importing. PG or whatever importing? Certifiable MSDS, RoHS, etc., reports? If we put it on the labels, don't we have to bring it in legally? Are we all practicing "civil disobedience" by not having these (aside from the FDA) and not paying duties and taxes?

Dell and Sony have codes and accurate RoHS, CE and UL certifications for Lithium batteries and chips from China (and elsewhere - Taiwan, Thailand, Japan) and pay tariffs. Even so, sometimes they get recalled as hazardous. They have insurance for this. They sometimes have to pay out millions in class-action suits.

What happens if a battery goes bad and burns a customer's house down with their family and pets inside? Are we ready for that? Does a label cut it?

This is something substantial, and I wonder if the ECA has answers or even more questions on the subject.
The whole country in inundated with suppliers' sites, and those suppliers buy from others, etc. etc....it is a little pyramid-like in nature.
All it would take to upset the enthusiasm of the product would be a disaster, maybe one that has been thought about but not acted on properly. There's bound to be some grave mistakes along the way, no one saw this coming, so how can we even imagine the road ahead.:confused:
So far we're all just going with the flow, some people better at organizing and protecting their business that others.
Lots of thinking to do here. And then lots of action. DO NO HARM,
but my favorite KNOWLEDGE IS WEALTH

I think you overestimate the resources of the various resellers. We are not multinational corporations.

I can tell you that I am personally working around the clock to have the most transparent and honest labeling.

You sound exactly like a politician. How about petitioning yourself?

I sell stuff in a flea-market (not exactly a multi-national corporation). I know my catalog company will back me up if I have any of these issues or else I won't sell it. I signed an agreement to that effect before I purchased a single item from them. Not one e-cig seller would do the same.

Will you? Mr. "personally working around the clock"? Gimme a break, please. You're just as greedy as the Tobacco and Pharmaceutical companies.

Except they pay out on their lawsuits.

You are smugglers, liars, bashing cut-throats to each other, dependent on child labor and exploitation of women (China), forged patents and falsified customs papers - forget about the labeling (you think that's going to make it all good - tell that to your local drug dealer).

I have dealt with alot of you trying to find out how to sell these things in the flea-market. (Please don't PM me). I opted out based on my research and experience with guys and gals like you personally working around the clock types.

As far as I'm concerned, you guys and gals (I'm ashamed of you) and the FDA were made for each other. You both get what you deserve.

All I have to worry about is a little rain on Memorial day. I'll always have another weekend. Will you?

I don't have an "LLC" sign. It would only get wet. LLC is a joke too. That tells me that if anything happened I couldn't get anything out of you personally, only your LLC. Now what would I get? Your worthless stock of returned and defective atomizers, chargers and batteries from your basement, bedroom, kitchen or attic "corporation".

Get real. Buyer beware. I stocked up, not because of the FDA, because you greedy, hypocrite suppliers will do yourselves in. I know the risks, I'm a big girl.

The ECA should consolidate all their member companies into one company and try to make this stuff here legally. Get a grant from the government and apply for an FDA NDA. Instead (pun intended) they'll bloog and blog with slick sites and LLCs to smuggle God knows what made by starving little girls and old ladies into the US.

I don't expect you to get a lot of attaboys over this indictment, Viper, but every seller needs to read it, understand it, ask if any or all of it is true, and act on it (assuming the game is not over and there is a future for these products).

Unfortunately, there's a lot of truth in it. And past statements by sellers cannot be recalled or modified. Claims will come back to haunt them, no matter future actions.

The big question now: Will any remedial actions be too little, too late? Hey, it's hard to take back the bullet you already fired.
