I love how the article shows the FDA contradicting themselves. They are mad the court overturned it insisting to treat it as a drug delivery device, but the court said no treat it like tobacco, then they go on to say that the court made an error hurting the FDA's ability to regulate it like tobacco?

What is their problem? I just do not get why they wont leave it alone? I know they have done testing, if it showed anything at all that was harmful they would throw it in the ring and ban them so fast our heads would spin, but instead this legal showdown is nothing short of a waste of money, our money. It frustrates me that they just cannot get over the fact that it is OVER....O V E R....move on, try another way.
I wish I could understand the reasoning behind them being so .... hurt over this.

It's disgusting. It's become a waste of taxpayer money...business as usual. Cut some of their funding and their job will suddenly become relevant.

HA! Just realized what I said. Their fear is that electronic cigarettes ARE cutting their "funding" by bypassing their little goldmines, commonly called "Nicotine Replacement Therapy" or "NRT's".

We don't wanna buy your ... GUM!

The article was very well done. The reporter has a clear understanding of the issues. Bravo!

I left this comment:

The FDA leadership should be ashamed of itself. While they waste our tax dollars beating a dead horse, the industry remains unregulated. Two levels of Federal Courts have recommended that the FDA regulate e-cigarettes under the Family Smoking Prevention and Tobacco Control Act. The Tobacco Act provides all the powers required to ensure product safety and proper labeling. In addition to refusing to carry out its mission to regulate products as defined by Congress, the FDA is guilty of something very akin to malpractice. No agency entrusted with public health should be using propaganda techniques to convince smokers to continue lighting up instead of switching to an alternative that will reduce the risks of smoking-related disease by up to 99%.

As long as the agency and other out of control federal agencies are allowed to spend, spend, spend yours and my hard earned money defending the cash cow of Corporate America, they will fight all the way to the Supreme Court and then may or may not abide even then. Why not? They have absolutely nothing to lose. We, the people are the only losers and have been for quite awhile.

As long as the agency and other out of control federal agencies are allowed to spend, spend, spend yours and my hard earned money defending the cash cow of Corporate America, they will fight all the way to the Supreme Court and then may or may not abide even then. Why not? They have absolutely nothing to lose. We, the people are the only losers and have been for quite awhile.

It's time to start putting together communications to the newly elected congress to put a stop to the FDA's continual attempts to bankrupt those that have a different opinion the them. Let's face it, with seemingly endless pockets of OUR MONEY, they are able to use the judicial system to try to protect their client, the Pharma industry. Unless congress convinces them to abide by the Federal and appeals court ruling, the will continue to stonewall (another safer alternative tobacco product I might add) their opponents until they rub out of energy or finances to continue the fight. They need pressure from above and perhaps pressure from above will convince them to be somewhat reasonable.

One—only one, mind you—of the infuriating things about this endless series of appeals is this story from September, where the FDA was knee-deep in credible public-health causes to pursue, so many they couldn't fund all of them. "Margaret Hamburg, commissioner of the FDA, however, says the agency lacks the necessary resources to do its job."

But they can find the money to field a small legal army—those guys don't work cheap—until, hopefully, the opposition folds for want of funding of their own.

Exactly. It seems like a game of poker where there is no table limit and the winner is always the one with the biggest pile of chips because everyone else is forced to throw in their winning hand.
That isn't justice, it borders on corrupt and unethical practice.
