Government is a slow, grinding business and by the time they make any decisions it'll be 2-3 years down the road. Then they will lose again in the courts.
In the meantime, ever increasing numbers of smokers will extricate themselves from the evil clutches of tobacco smoking and turn to vaping; batteries will become more and more powerful and electronics will include a stealth vape feature that incorporates the ability to blend into surroundings. Disagree completely about this time frame.
We are relying on the "grace" of the FDA and Federal Government to A) read our comments and B) make any adjustments based upon them.
Their time line was laid out fairly explicitly in the deeming regs and their view of what an "ecig" should be as well.
We are fighting powerful, well funded & organized enemies of vaping.
The FDA "lost" their original battle based upon semantics--specifically their attempt to classify an ecig as a "medical device". The industry won by arguing their status as a "tobacco product".
The FDA fought this every step of the way.
What is the legal basis upon which vendors or manufacturers (assuming they even have the financial means) have to win a battle in courts once the FDA presents their final version since their authority is based upon the Family Smoking Prevention and Tobacco Control Act signed into law in 2009?
I hope I'm wrong but I think this industry (and we vapors) are in for a rude awakening.
I have only to look at what the govt did to the online poker industry that was killed at the very height of its popularity.
While gambling is perceived as a "vice", smoking (and that's how vaping is portrayed) is EVIL INCARNATE--and one the govt currently makes little money on.
