No, but only because second-hand smoke has been "shown" to be harmful to others. The right to pursue happiness is greatly diminished at the point where it begins to harm others. Second-hand vapor, OTOH, has not been shown to be harmful in any way.

Now there's still some debate as to just how harmful second hand smoke really is, but unless/until there's SOME evidence second-hand is harmful, vapers' right to peruse their happiness should be respected.

This is why people in the Czech Republic live the American dream. Pretty much everything is allowed, as long as no one else is legitimately being harmed...

Have smokers successfully won legal cases for their right to smoke wherever they please with that argument?

Nope, but I'm glad they haven't. It's unfortunate that we need laws in order to not have people step all over each other
as they do their thing.
When I smoked I would never even think of firing up a smoke in a restaurant, not even when they had smoking sections.
I know that second hand smoke can be harmful and also ruin an expensive meal
But some people don't care how doing their thing affects others so we need laws to keep everybody from
violating the inalienable rights of others.

I don't remember either the constitution or declaration mentioning ethics or civility
but I do believe the "under god" part covers all that.

caramel, when was the last time you went to an ATM and didn't have to stand in line with a bunch of other people?
Maybe it's my location but I'd say almost never.
I think those regulations (which I haven't read) are probably legislated because
though the ATM machine won't be bothered by your vapor the people using it might be.

We must help them, they have children. Customers must pass a body mass index before placing an order.

Trust me. I'm working on it. I applied for a job with the company I work for who has a site in CZ. If that doesn't work out I'll consolidate my assets and move next year...

Honestly, no. I haven't read the OP but the comments about it. And, no. Vaping in your car should be your prerogative as it bothers nobody.
Even in Florida where driving is a privilege and not a right, police need a warrant or probable cause to search your
"private property". The fact that my truck is considered private property makes it an extension of my home.
Considering that my home is supposed to be out of bounds for the law
(stress supposed to be, ever since the no-knock law was passed that's an iffy presumption)
so should what I do in my vehicle.

Moreoever, since ATM's are usualy on private property it's not like you're driving your private property on the public street
which is what makes it a privilege.
In short, I agree with you and the law, which I haven't read, is ridiculous,
If the law restricts vaping outside where others get to deal with it
I can condone it but in your car, no way

I was just thinking... I would have been arrested for a number of things which I did this past holiday in Prague, had I been in the US, yet no one there batted an eye there- even the police, and no one was harmed, except for one poor soul who couldn't keep his hands off my date...

Wait a minute. Are you saying dates are illegal where you live? Well, you can always eat figs...there are always alternatives and ways around stupid laws.

Drinking in public, being drunk in public, launching non regulated fireworks and firecrackers on NYE on the street, procreation on a side street early in the morning with a lady friend- one of the cops who happened to walk by gave a thumbs up, a ménage, vaping at the airport, vaping on a train, taking a friend from a travel site who happened to be in town to a gentle men's club/brothel, gambling, a little bit of the other stuff...

Me personally I don't vape in indoor places that don't allow it. Except for the occasional vape in the bathroom or if I am in the movie theater. At the movies I tend to stealth vape and only just enough to help crave my nicotine fit I am having at the time. If I am outdoors though I will vape anywhere i want.

I went out to a couple bars last night. The bars in this town do allow smoking in them. In the first bar I went to, pretty much everyone was a smoker. Which didn't bother me much. I sat there and enjoyed a beer while I vaped. No one said anything or gave me any looks but I did feel a bit out of place. Went to another bar after that but wasn't there long. Found out they didn't accept debit cards. Cash only. But before I found that out while I was still deciding what I wanted, i got to chatting with other people. Most around my age or young (i am 30), one of the female bartenders actually had a vaporizer herself. There were smokers in there too but I didn't feel out of place as much. When I am in public I have had a few people give me looks with it but not say anything most of the time. A few times I have heard the "Their worse for you then cigarettes" line. I usually try to educate them but some won't ever listen. When I first started vaping I had a guy ask me about it at the laundry mat. I explained it to him. I let him try it. He liked it. He was prob in his 40s and a smoker but seemed really interested in it. I wrote down the info of my setup for him. At the time I couldn't really give him more info then that like I could now. But anyways no idea if he ever went through with him since I didn't see him again but hopefully he did.

The reason I think so many ex-smokers try to vape everyone is because they want to take back their freedom. As smokers they had right after right taken away from them. To this day their still cracking down. There are cities and some towns where they ban smoking and even e-cigs in their bars. Not the bar's choices mind you. Rather the city or town. Bars hate it cause it hurts their business. Let's look at the rights smokers have lost over the years.

1. First they were gathered in smoking only rooms. Which was of course even worse on them in some places. But it was fine and tolerable. That is how it was in most restaurants when I was growing up.

2. Restaurants and pretty much every public place banned smoking inside them. Fine smokers could understand that too.

3. They banned smoking in most Zoos. Ok understandable. Annoying for smokers but good for the animals.

4. They began banning smoking in front of public entrances. Some places this is manageable. Some not so much. Especially if it is a strip mall or something.

5. They started banning them completely from hospital property. Ok some started this before the entrance ways thing but still. This even includes parking lots. something which as a smoker I never obeyed. I'd still go out to the car or somewhere else in the parking lot to smoke. My mom has been in the hospital a lot over the years. So I have spent a lot of time at hospitals.

6. Statewide bans of Smoking in Hotels. Indiana is one of those states. Then you get people from out of state complaining of the smell of a room wondering if it used to be a smoking room. Anyone from Indiana knows odds are it was a smoking room at one point. Smokers still find ways to smoke in them too. Such as putting paper towels on the smoke detectors so they won't go off. Crack a window as they do it. the cheaper places won't complain about the smell usually.

7. Towns and cities began putting smoking bans on bars. So every time a smoker steps out for a smoke they run the risk of being arrested for PI.

8. Towns and cities put bans on smoking in parks. Ok not exactly a new one but still outrageous. Cig butts only started to become a problem in parks after they put this in. Parks that used to allow it used to have ash trays around and a lot of people usually would use those. Not all of course but still. I have even seen a ban of not smoking within 15 feet of the park. Yeah needless to say I never obeyed those bans. Usually didn't get people saying anything to me about it.


They keep trying to put more and more bans on smoking in places. Smokers are tired of it. So when they come over to e-cigs they know that these aren't bad for others like cigs and that there is no good reason for those bans. The smoking bans were supposed to be there to protect the others. It is the only reason smokers caved so much. Many of the ads for ciglikes that target smokers like to throw in stuff like "Freedom to smoke anywhere" and stuff like that. Or "Regain your freedom". So when they turn to vaping they expect they should have those freedoms. In all rights I think they should as long as they aren't billowing large clouds. Instead they are stuck having to follow the same restrictions as smokers. They think to themselves "But I am not smoking. Shouldn't I be free of that". While I try to show respect for places and people, even I hate these restrictions. To make matters worse their trying to constantly impose tougher restrictions and laws. So yeah some people have become a holes and vape anywhere. But at times I almost can't blame them. Not with how we are all treated.

Might I add to your list, if you don't mind:

Here in Taiwan, The government are very much ALL OUT against Smoking Cigarrettes (Including VAPING because they DO NOT Understand Vaping)

NO Smoking in ALL Parks, includes memorial, botanical, theme parks and etc.

NO in ALL Indoor Buildings and Establishments Both Private and Gov't owned meaning the whole block and surroundings of the Building.

In addition to the above mentioned, NO Smoking in Movie Theaters, Restaurants, Convinient Stores and etc.

NO Smoking while Riding your Motorcycle, Scooter, Bicycle.

NO Smoking EVEN inside your OWN private property YOUR OWN CAR.

NO Smoking inside the house is BANNED by your wife and/or family, NOW,

NO Smoking at your OWN house's BALCONY, PORCH because IF your neighbors complains about it... YOU GET THE FINE ! of NT$1,000 to NT$10,000 (Equivalent to approx. 30 USD to 300USD)

PS. NO SMOKING Ban here Includes NO VAPING.

So Folks, Welcome to Taiwan.

And so, there goes "OUR" freedom.

IMO, Smokers are PUSHED around by non-smoking public due to the government's LAWS...

more and more The "We are CLEAN (Good guys)... You are BAD/DIRTY/STINKY (Smokers and also Vapers are treated as such) people." SYNDROME is being imbeded to the Brains of the public nowadays.

So, yes, I agree SMOKING is now a "CRIME" and so Vaping is somehow... much "less" of a crime.

Ive never been harassed for vaping. I always figured I would steal an old bill hicks line if I do. It went something like

"This guy came up to me while I was smoking and started fake coughing. So I said 'shoot you shouldn't smoke if you are coughing like that'

Totally miss quoting but im too lazy to go find the video.

Cool!? I counted 112 ladies of the night in a half hour when in Washington DC once..
This was on M street if I remember correctly, a couple of blocks from the White House.
I started counting while I waited for my girlfriend, got propositioned several times.
Then when she finally showed up she helped me count to make sure we didn't count the same girl twice.

Anyway, that was in Prague?
Wow! I have a theory. Prague is so much fun because in 1993 it again became a cultural center of Europe,
and place to go for tourists because of the many landmarks of it's 1000 year existence.
it is still new like an adolescent child playing with it's new found freedom.
You guys have a very interesting history.
Tell me, do you think if the Czech Republic wasn't in the European Union, do you think it would be as freewheeling as it is today, as much fun? If it was still Czechoslovakia and the Iron Curtain wasn't torn?
Would de-annexation if you will, influence your ability to find vaping supplies and juice.
How readily available are they now?
