Got written up for vaping inside at work

Like I linked to in a previous post the Colorado Clean Indoor Air Act of 2006 clearly states no smoking in workplaces unless exempt.
The OP doesn't work in an exempt workplace = no smoking / vaping.

How does the state of Colorado define an e-cigarette?

" Cigarette, tobacco Product or Nicotine Product means “(I) A product that contains nicotine or tobacco or is derived from tobacco and is intended to be ingested or inhaled by or applied to the skin of an individual; or (II) Any device that can be used to deliver tobacco or nicotine to the person inhaling from the device, including an electronic cigarette, cigar, cigarillo or pipe.”
" Colo. Rev. Stat § 18-13-121 - 5"

In Colorado ecig/vaping falls under the same controls/restrictions as smoking.
Meaning you cannot vape in places smoking is prohibited, simple really, if you go to the actual source.

Yes, the Op stated... someplace... that wasn't him. I do question his "role models" though. Not just the avatar, but.... This is a gentleman who needs a bit of "entitlement" knocked out of him, an I also sympathize as I have been busily doing that with the kiddo ever since sports handed out participation trophies, and he desired to go to a public school. Fortunately, he chose the "I will get into trouble" road, which is actually easier to fix than the "I have been programmed by the propaganda road," which what, exactly, to educators think it will bring the kids, anything good???? REALLY?

My
kid whines about his work, but it's more connected to needing/wanting more HOURS, not whether he can vape or do other things at work. My child (even when vaping still) would NEVER vape openly on the floor of his work. When he used to vape, he would save it for breaks or bathroom breaks. He doesn't care for his manager much but he remains polite, as he wants to keep the job until he moves.

There is often not enough "These are the skills you will need to get by in life," done by learning institutions or even sometimes "society" any more. The parents need to do it.

The first time my kiddo complained about his manager, I gave him a "long talk" about his "expressive face" (I have one too, and have had to learn how to control it," and then sternly told him to not expect me to help him find another one (or to support him) if he was fired for just cause. He got it in like a 3 minute conversation. But, someone has to have those talks with these kids.

In 4 years of working there I have never had one lunch break tho I work over 8 hours yeah its a gas station but by law I'm entitled to a break yes?
OSHA. Make an anonymous call...
Won't accomplish much, but may make them reconsider how they treat their people.

So basically your saying you have no understanding of what socially courteous behavior is and feel that as a representative of your company they must hold your hand and explain and then mandate common courtesy.

It's a wonder you weren't fired.

Your not a customer, your at work which means your supposed to be working - not blowing clouds. Grow up. Vape on break.

so is burping and farting not allowed either?? ;)

Applying either solution might work.

It also might get him fired or laid off but not immediately at first.

I usually only resort to those remedies AFTER I have located my next job. And this last one, I didn't even bother a) because it was a Native Reservation and everything is different and b) because I got to know that tribe well and deeply enough to know that even calling in OSHA would have potentially brought me and my family "troubles."

I applaud whistleblowing if it is the right thing to do but there are many real world situations in which that is impractical. And he's already been written up once.

My recommendation in these sorts of situations is to find a better job, then address anything that could need "addressing" AFTER that step has been completed. Etc.

OSHA responds and you lose the job anyway. Think the OP came to vent, doubt anything we have to say will help. Has he even been back?

After reading this I took a dump (defecated) on my bosses desk.There weren't any signs saying I couldn't, and it was not written in my handbook.Hope I don't get "written up".......:D
P.S. There is nothing common about sense.
