I've asked this repeatedly, and I've never gotten a good answer: How does a state like Indiana or Arkansas go about fining a business that's not located within their state? Let's say I have an e-liquid business in some other state, e.g. Florida (I do not, this is hypothetical). A customer in Indiana orders from me on my website. Legally the transaction takes place here in FL, as evidenced by the fact that I do not have to collect Indiana sales tax. How/why is this transaction subject to Indiana law?
By auditing that company. I had a friend who was buying cigarettes online from Kentucky I believe and he got nailed for taxes. Paper trails. Just a thought...

And Isn't part of what will start happening on August 8th 2016, for Anyone who sells a "tobacco Product" in the USA, is that they must Maintain Sales Records?

A lot of us are planning on buying ejuice online and having it shipped to a friend or family member out of state and having them send it to us. Are you saying that an auditor could discover this and the buyer, the vendor and the person it was shipped to could be in trouble?

How would an Auditor know what happens to an Order once it is Delivered to your Friend in say Ohio or Florida?

BUT...

If your Friend then ships it to You then Both of you are running the Risk of doing something that Might Not be viewed favorably by the State of Indiana.

I would Drive Out of State, Load Up, and then drive back into Indiana. If this is Possible.

I would Drive Out of State, Load Up, and then drive back into Indiana. If this is Possible.

It's my understanding that we can't purchase or receive ejuice from out of state online if they aren't buying from one of the 6. An auditor would see the purchase by me, thus I'd be in trouble (no biggy) and possibly the vendor. If they really want to get nasty they could check on the receiver but I guess they would have know way of knowing what he did with it but I think the vendor might be in trouble and I really don't want to risk that.

I only buy 1 flavor and I believe the vendor is on the west coast. I could do without it but I don't want to put up with this BS and want to see if it can be done without anybody except me being at risk.

I couldn't care less if anybody views this action as unfavorable. This whole stinking mess is unfavorable.

I'd like to hear for others about this, especially @Hoosier. Thanks DoiDman for your thoughts. :)

Who is going to perform this audit? An auditor working for Indiana has no authority to see any records belonging to a company that has no presence in Indiana. I've had auditors from the California Board of Equalization demanding to see my records for sales my business made in California. I told them that unless they got an order from a PA or federal court requiring me to cooperate with them, I wouldn't so much as give them the time of day. This was many years ago. I never heard anything more from them.

Yes, I read that and am now wondering how they are going to enforce it. I don't think they can. There would be a paper trail but I think only the ATC could do the auditing. Are they going to hire hundreds of new people just to audit vape shops (B&M or online vendors). I just don't think so. But I've been wrong before.

I would do that if the one vendor that carries the 1 juice I buy did business in one of those states but I can't. I DIY so it's not a big deal but it's the only store bought juice that I love and I wouldn't mind sticking it to the IN government either. I'll just do without it if I may be putting anybody except myself at risk.
