Ok, I read the brief (yes, I understand all that legal bumf). The suit alleges both patent infringement and marketing collusion intending to drive Evolv out of business. It is not clear from the original filing whether Evolv thinks they have patented the very idea of a 200watt personal vaporizer, and nobody should be allowed to make one at all, or of they feel Wismec's "reverse engineering" has produced a board so close in design to Evolv's it amounts to unlicensed production. Perhaps they mean both. Presumably they will make that clear at the trial. They're asking for monetary damages and a cease and desist order. I suggest you all buy all the RX200s you want right now.

I will make 4 predictions:
1) This is going to be bad for the industry.
2) If Evolv wins, Yihi is next, followed by everybody else.
3) Unless the board itself is ruled to be a too-close copy, that is if Evolv prevails under the theory they own the idea of "wattage control," Joye can probably continue selling the same board with a firmware upgrade requiring the user to set power in volts rather than watts, and just have the board calculate and display the applied watts as measured against the coil resistance as a derivation of Ohm's Law, which can't be patented. Indeed, they might even moot the suit like that. And so long as they sold it in voltage mode, they might even get away with a free-download firmware upgrade that changed it back to watts control.
4) When word of this gets out, because of 1) above, methinks Evolv will see less interest in their boards.

They invented watts? I think James Watt would beg to differ.
No, it's an application patent. They claim they own "wattage control in personal vaporizers." If you hold a patent for a camera that takes pictures, there's nothing stopping somebody else from patenting the use as a door stop.

Oh good god. That's like saying the first car with an odometer measuring mph patented that term for odometers in cars.
