What a rotter calling on ecig users to file suits against suppliers.

The man is a humbug :grr:

real users or contrived ones.. in such a litigious minded society it sounds a very effective way to kill off small emergent industries..

without the money to fight them off folks are kind of f-cked..

cant e cig users file one against him.. like for conspiring to endangering their health and killing them..

he aims the law at others its probably time he got it aimed back at him.. conspiring to endanger the lives of others by denying them right of access to a less harmful way of smoking..

i think a good case could be made..

I don't understand why he is given so much credibility. He is a lawyer. He has no medical or scientific expertise of any kind. So, other than to avoid a lawsuit, why does anyone listen to him at all?

i would guess that in the world we have live in lawyers have had a higher status ranking than doctors.. he also has a big mouth and knows how to use it to best effect..

The main reason? He sends out press releases, every day, all day. He picks up the phone and talks to anyone who will listen. He sends a letter and Amazon, Paypal, Facebook, even the FDA roll over and say "please don't kill us".

He has millions of dollars at his disposal, hundreds of students who work for free and thousands of very organized and well trained activists he can call upon to help.

What have we got?

The reason i've been posting his stuff, which honestly kind of makes me nervous, I don't have the money to even respond to a lawsuit if I say the wrong thing and he sues me for slander or something, which he would, but is to get the word out into forums like this so that we can get just as organized as the anti smoking folks.

IF you don't know what your enemy is telling people about you, how can you respond to it? It's time to see the manufacturers, the retailers and more importantly, the VAPERS writing some letters, calling some press and politicians, talking to your doctors and getting them on our side. The time to get busy is now.

Just look at what these people have already accomplished. They are not to be under estimated. If we sit back and let them have the stage much longer, vaping with either be a thing of the past, or something the Pfizer corporation sells us in five years.

You think they don't pay attention, look at my traffic log and this might give you an idea:

Banzhaf is brilliant at playing the odds and has a fake it until it's true mentality. Further, his website demonstrates just how rabid his antics could be:

He has an office on H street, as well as K street, where all of the big lobbyists are located. As far as I can tell...the man's main source of vulnerability lies in his pride via self-proclaimed success. People have grown weary of his incessant need for attention. Hopefully, the repressive measures he is lobbying for as punishment for lifestyle choices will be viewed as cruel and inhumane thereby losing favor with the population. Until then, we hammer away at the lack of compassion and his emphasis of just how much a human's health is worth in Banzhaf's point of view. He loves quoting just how much humans cost healthcare so much one has to wonder why he emphasizes money so much.

His views on the e-cig class action suit makes it very clear that first filers and the attorneys will be the people who collect the big bucks. Of course he knows this for a fact...it's how he enriched himself.

Sorry to go off on a rant but this guy is worse than a late night preacher requesting dollars for "miracle sand" to sprinkle one's problems away. He never tires on topics related to money. 8-o

zi still don't understand how you can file a class action lawsuit when no damages have been done. Has there ever hear of a case like this. If they sue some of the ecig suppliers all they will get the company's assests. None of their personal assests will be affected.

Please refer me to a class action suit.

Martha--the alleged damages sounds in Fraud and Misrepresentation. Under most states Unfair Deceptive Business Practices Statutes, the advancing party need not show damages. It is punitive in nature to protect consumers.

As much as I hate to say it, technically, he's got good footing. There are many people who sell ecigs as a 'safer' alternative to smoking. Well without proper testing from a legitimate source in THIS country, there is nothing to keep him from calling b.s. because he has an FDA test on his side.

Now granted that test has been blown out of proportion, but without our side having something to throw against it, we dont have a leg to stand on.

Oh well, you could look at it another way: hs 'class action suits' could clear the dubious companies out of the market (assuming that they are on the basis quoted - ie misreprestation), leaving the good suppliers intact. Could actually do us a favour in the long run! 8-o

Regardless of how the SE/NJOY ruling comes out (including the possibility of a settlement,) the FDA will be able to crack down on advertising, packaging, content, etc.

Class action lawsuits will place additional burdens on manufacturers and suppliers. They will only help a few people make a quick buck, mainly the attorneys.

And then there's the bad press that will come along with the lawsuits. Great.
