Let's hope they challenge that one in court. But if they don't allow e-sales within MA, they won't allow them from outside MA either. So it's a total e-ban, not a selective ban. So maybe they can't challenge on damage/unfairness grounds.

The good news is that they've apparently acknowledged that the vape-shops card. So that's more suited to the save-the-children agenda.

Agreed, except when you think through the logic, he's really saying its impossible for convenience stores and gas stations to enforce the underage sale laws. Why should all adult users of a product be inconvenienced because the state can't enforce a law? They should start pulling tobacco licenses for breaking the underage sale laws and see how quickly this snaps into place. A manager of a chain convenience store certainly wouldn't want to report to the home office that they lost their tobacco license for a month for selling to minors. I think all of this is for political showboating.

Bolded, it is though.

Also maybe they should start hiring secret shoppers or how i should explain it. In sweden we've people looking like an everyday guy, and go secret shopping. Only to test if they follow through regarding tobacco or gambling.
Naturally they only hire people that are of the age 18-20 to look as young as possible. I believe they call themselfs mystery shoppers.

But yea every time someone breaks rules here (checking id etc) they will be noted and reported. And due this is a thing most shops never breaks this. Which is also abit annoying for us adults, because you will be ID checked even in your 40s. Due they can never be sure it's a mystery shopper or not.

So i guess this is a thing US could learn from.

But ye overall, it's just the politics in the end and we all know it. But if it's so important to protect the children. Then maybe start acting like it actually is. Such as with the example i just now mentioned.

So the "mystery illness" is no longer a mystery, why not lift the ban?
Finding hardware is fairly easy, ordering juice is another story.
Well, it will be lifted 2 weeks early (Dec. 11) but Baker just signed a Bill banning menthol cigs and all flavored tobacco and vape products starting this June. Tobacco flavors only (NETs anyone?) and vape products will be taxed as cigarettes at 75%. But you probably already know this.

And he added that someone had to make the first step and that hopefully MA will be the example for the rest of the states.

I feel nothing but pure venom in my heart.

ETA: I heard that you will be able to purchase menthol cigs only at smoke shops. The whole thing messes up sales for convenience stores/gas stations. And if you can then get menthol cigs at a smoke shop, why not let us buy flavored juice at a smoke/vape shop?. The whole thing is imbecilic.

We actually do have "mystery shoppers". The local liquor store got fingered for not carding. It's usually a fine at first. If it keeps happening you can lose your license eventually....but probably not until they get a good amount of fines out of you:facepalm:

Someone as in friend? Some juice vendors have declined shipments to MA. I know, I got the notices when trying to place an order.

That stinks. I’ve been lucky since I’ve taken some time off from DIY MVP has sent me several orders of juice and hardware. They’ve had some “decent” sales too. Since I don’t normally vape manufacturered juice I don’t mind splurging a tiny bit on juice until I’m on my feet (hip really) and back to mixing for myself again which may be soon. Couple of more weeks I hope.

The FDA does these sting operations.
The problem is the penalty is not strong enough, usually warning and/or fine.
They need a larger fine and/or loss of license.

Agreed.

Just one more thing that Congress is Not Getting Done. Or even working on.

"...

The Tobacco Control Act provides that the amount of a CMP for violations of the regulations in part 1140 shall not exceed certain amounts, depending on the number of previous violations, the time period in which the violations occurred, and other factors (see section 103(q)(2)(A) of the Tobacco Control Act). The current maximum amounts are:

Number of Regulation Violations CMP Amount

1 $0 (CTP will send a Warning Letter)
2 within a 12-month period $285
3 within a 24-month period $570
4 within a 24-month period $2,282
5 within a 36-month period $5,705
6 within a 48-month period $11,410

Talk about just making it up as you go along. Who would come up with a specific $2,282 amount for a fine? Did staffers actually sit around and negotiate these numbers between themselves? “$2,200 sounds too low. Well I like $2,500. I’ll raise to to $2,250.....”.

And we pay their salaries and benefits.

This just sounds like they actually want them to break the rules, just to get some extra cash in.
Atleast in sweden you will loose your ability to sell tobacco or your right to provide gambling if this occurs.
Altho i'm sure they will be allowed a warning or 2, but after that you'll go down.
I know this first hand due, when i was young we all knew the places who didn't ask for ID. So we all keept going to these places for our cigarettes.
But they were also very often closed down. Only to come back later with new owners.

So yea, seems like a problem that needs to be taken care of, especially if they are going to keep using the "what about the kids" card, that's used all to often.

2-3 warnings max and you'll loose your license, sounds fair enough to me.

Yeah... this is a Good Example of when the Feds can't get their Act Together, or when they aren't even Acting to Act, the States need to be the ones who Step Up and get something Done.

Damn it. I was at their grand opening. Good people ....ed over for MSA blood money.

How sad. I was infuriated to see the photo of Gov Baker clapping and the photo of him and the antivape politicians all smiles as he signs the bill to destroy vaping and vape shops.
