Additionally, it is unclear what health effects these products could have on users or if misuse or product failure could lead to nicotine poisoning or other serious adverse health consequences.”

Okay, what a CROCK OF ..... They're trying to say that if PVs are allowed, more people might try smoking real tobacco... Okay, except that even MORE people will absolutely use tobacco if PVs are banned because they'd been using PVs in place of tobacco... Which means that what they're supposedly trying to prevent by banning PVs is EXACTLY what they will CAUSE by banning them. Are we being ruled by a bunch of ......s? Or are most people just too stupid to see how full of .... the powers that be are? This is friggin' ridiculous...

Everything I read that's written by someone other than forum members/e-cig users just pisses me off to no end.

Respiratory irritant... That's why they use it in NEBULIZERS, which are meant to be INHALED by people who have ASTHMA... Oh no, nicotine. Real cigarettes don't have nicotine, and they're so much better for us, aren't they? "Other substances the FDA labels as carcinogens and other toxins." So... These artificial food flavorings are cancer causing toxins?? THEN WHY ARE THEY IN OUR FOOD?? I love how something is perfectly okay for us to eat, but not inhale. Okay, this is the way I see it, but I know it will never happen. If they're going to ban this, then they have to ban the same chemicals from being used in any other application. If they cause cancer with this, they cause cancer in other applications too. This is so utterly absurd...

The FDA needs to be gotten rid of. They do absolutely nothing useful or helpful anymore if they ever did in the first place. All they ever do anymore is protect the special interests of the people that line their pockets with money. They constantly allow all kinds of ....ty drugs that make people go nuts and/or die, and then they turn around and pretend that they're concerned with our health so they can ban e-cigs? BULL..... They don't care about our health one bit.

Go look up Coumadin, AKA: Warfarin Sodium. It's commonly taken by people with high blood pressure. Its original use was rat poison. And it's dispensed by pharmacies every day to many, many people. It's FDA approved...

Yeah right... Okay, even if that's true, does that mean that NOBODY should be allowed to use it? A few people are sensitive to it, so nobody can use it? Some people are allergic to coconut, shellfish, peanuts, etc. Should we outlaw these foods too because of a few people that can't eat them? By the way, I LOVE how anecdotal evidence is perfectly okay for them to use AGAINST e-cigs, but they'll be damned if they're gonna let the opposition use anecdotal evidence to support how well these work for getting people off of real cigarettes. ....... hypocrites...

As scary and irritating as this is, I have no concern that electronic cigarettes will be banned for long if they do get banned. The evidence is just too overwhelming for why e-cigs should be legal... they've helped too many people. As more people switch to e-cigs and more people become educated, it will become more and more difficult to make a case as to why they should be banned. Keep vaping.

I'm in Andrea Stewart-Cousins' Disctrict (District 35)
I was kind of upset that she didn't find it important enough to participate in the hearings last week that Sen Duane hosted given her district starts in Yonkers some 12 or 13 miles from where they were held. Wondering if anyone has any suggestions on the best way to find out what the senators' position is on PVs and how to make some leverage out of their aparent lack of interest in the subject or lack of concern for what others might say.

Tom Duane is mine. I really like him and hope I don't have to vote against him.

I missed that there were hearings but what I'm planning on doing is organizing my thoughts and calling his office to find out where he stands.

Take a look on the CASAA site- the folks who presented did a great job. Not clear where Duane stands but at least he was there ....

I know how to contact my Senator, just wasn't sure how to make use of the fact that she wasn't at the hearing....
Here's what I ended up sending to her:

"Dear Senator Stewart-Cousins -

I couldn't help but notice that you were absent from the hearing held on September 23rd -Impact of New York State’s Clean Indoor Air Act (Public Health Law, Article 13-E) on improving public health. I hope you've had an opportunity to review the video from that hearing- Particularly, the discussion and testimony that came late in the day, on electronic cigarettes and the proposed ban on these devices.

As one who has used electronic cigarettes as an alternative to cigarette smoking, I am interested in knowing your position on them. After trying most of the normally prescribed drugs and procedures over the past few years to stop smoking, I found out about electronic cigarettes (AKA Personal Vaporizers) and conducted my own research before trying them. By using these devices I have successfully stopped smoking for over 4 months- something I had been unable to do in over 30 years.

I trust that you take your position on the health committee seriously and as such will review the information on the CD that was given to Senator Duane. This material includes research showing the safety of these devices as well as debunking much of the misinformation that suggests these devices present any sort of health risk.

I believe these devices to be safer than cigarettes and second hand vapor from these to present no more risk than the air in a busy commercial kitchen. I hope you can take the time to better understand how these devices work before voting on any legislation, and I look forward to hearing your position on the matter soon.

Thank you for your consideration."

I can't believe I missed this video. I'm originally from Maryland. Close enough to New York to make me want to puke. Maryland has always been the forefront in new laws to pass first. Yet I haven't heard that MD has even mentioned the banning of ecigs. New York legislature is a joke. Didn't anyone look into it before making a vote on it? Didn't one of those people mention that he used one of them? What the schitz is going on? Didn't it help him to stay away from analogs? I feel sorry for the vaping people of New York. You're in my prayers. California won't outlaw them. Schwartzy wouldn't let it go through. His opinion is as adults we can do whatever we want including using nicotine as long as it stays out of youngsters hands.

Do you think it will over be overturned? I read somewhere that a US Supreme Court Judge overturned the ban but was that on federal level? Unfortunately, I know that each state is independant but still, the federal gov should rule over them.

I can only assume from your question that you don't realize that, fortunately, the ban was not passed.

The video at the beginning of this thread was of the Assembly passing it. However, the Senate never acted on it during the term that ended last summer, so therefore NY is banless for now.

It is not over yet though.

Most recently, on September 23 the Senate Health Committee held a public hearing on several pending pieces of legislation related to smoking and tobacco products, including the ecig sales ban proposals, and the ecig community and its defenders had four speakers presenting at that hearing. There never was a federal ban, nor a US Supreme Court case. Perhaps you are thinking of the litigation that has been ongoing in federal court in the case of SE and Njoy (now just Njoy) against the FDA. See, http://www.e-cigarette-forum.com/forum/casaa/92116-overview-smoking-everywhere-vs-fda.html

Last January a federal District Court Judge issued a preliminary injunction against the FDA and in favor of the two ecig companies; that decision has been appealed, and oral argument in that case was just heard in the federal Circuit Court of Appeals, coincidentally, also on September 23 (the same date as the NYS public hearing mentioned above). Amazing - we have a call to action to stop a ban in NY and posts from all around the world taking shots at NYers without any understanding or appreciation of the dynamics. If you watch the discussions at the political leve, particularly the hearing held by the NYS Senate Heath Commitee, the justification for the ban is based on the disinformation coming from the FDA the federal government and others. Most fail to make the distinction that nic cessation and smoking cessation can be two different things...

Not worried? Fine if you have Arnold as your governor and he tells the lobbyists to find another ax to grind (as long as he is governor), but for the rest of you, you could be next. Get on your congressman or senator to put some pressure on for better/more fair testing or accept that we're going to end up with a black market. Even if it doesn't pass in NY, some the forces at work here have deep pockets, national presence, and religiously believe that these things are bad for the poor smokers as well as anyone standing nearby.
