It has just come to our attention that the New York State Assembly voted unanimously to outlaw the sale of electronic cigarettes last week.

You can view the "discussion" as recorded by an ECF member below. Please note the total lack of debate, and the rehashing of the misleading FDA statements from last May.

All is not lost, however, as the Health Committee will also be voting on its version of the bill, and it is this that will be passed to the senate. Please therefore, contact all members of the health committee (details in following post) and urge them to vote against this cruel and inhumane legislation.

If possible, please call them and/or fax them - this is much more effective than emailing, as was discovered in the Illinois action.

Remember, if this passes in New York State, we will likely see many other states crumble without opposition.

I received automated replies from most of the health committee members, but since I stated clearly that I'm not a NY resident, I don't expect much of a response. I'd hope that NY residents get more of a follow up. It looks like open comments website isn't getting updated fairly frequently. But since the comments are sent through a moderator, they will at least have a record of them.

There is no way my car can or will make it to Albany . . . Carl Kruger is the Senator from my District. The calendar on his site has him in Albany until the 29th . . .

Do you think it would serve any purpose for me to visit his office to hand deliver a letter in person and demo my PV for his staff or hold out and try to make an appointment with him since as of now the bill doesn't seem to be on the agenda for the 27th?

Senator Marty Golden is having a Town Hall near me in Brooklyn, NY on Thursday the 29th which I had planned on attending and still will if the bill is not on the agenda come the 27th . . .

Thoughts/input?

Sheep following sheep , no sense at all , with that type of legislature anything can pass !

I guess they will have to sell Personal Vaporizers instead !

If you think RJR and PM had nothing to do with that, especially in New York, where cigs are nearing, if not already hit 10 bucks a pack, you're barking up the wrong tree.

All those tax dollars, especially without FDA (read, big tobacco and medicine) backing that would be lost by actually telling people they could buy a healthier alternative to tobacco. These guys need their vacations, you know. Even easier when they can mask it behind being "for the good of the children". Leaving the door for "when it's approved by the FDA". Which only means, when people find out how to profit the most by taxation and addiction and exploit the crap out of it.

There's definitely not ignorance here, as it always is and will be, they follow the money and do not give a damn about the rest of the issue.

Even if it kills people.

Eliminating the sales to adult these donkey asses (pun wholly intended). Let's focus on the sale to children, and ban it like every other nicotine delivery device. They know .......ned well it is safer than ordinary cigarettes, it's just big tobacco, the "anti-smoking" donkeys (ya, anti-smoking my ....), and the medical association making plans to drain our pocket books at the expense of our health. I officially DESPISE our government. Worthless bloodsucking a-holes.

They're not trying to tax them,
they're trying to ban them
and they're trying to do it so quickly.

Letters and emails may not be enough, when their mailboxes are sending automated replies. I have a feeling people need to actually attend the meetings, then the vapers can bring the letters with them. Even if some do not get a chance to read their letters, they can at least present them personally at the meetings.

NY residents should definitely try to attend the meetings and try to read their letter that they bring with them.

Unfortunately, I don't find this in the least bit amazing. Many politicians, if not most, really don't know anything more about a subject than the average person on the street. The average person on the street is woefully ignorant about anything they're not directly interested in. Their "sponsor" representative who did "so much hard work" mainly had make sure her flunkies typed up the proposal in legalese. She didn't research anything, just like most politicians don't bother digging into the facts of a subject before declaring a position on it.

This is very clearly a case of passing the buck. They're blindly deferring all responsibility to the FDA as an easy solution. In theory that's a great idea, the FDA is supposed to provide an independent and reliable judgment about whether a consumable product is safe for intended use. In practice... yeah, not so much. We all know that, but that's because we're personally invested in the topic. Most politicians aren't.

I think you've hit it on the head with selling "personal vaporizers" instead of electronic cigarettes if this type of legislation is passed. Same general scenario the tobacco supplier I used to buy from had to deal with. Politicians raised taxes on cigarette tobacco through the roof, so most suppliers of loose tobacco intended for rolling your own started calling their product "pipe tobacco" and successfully dodged the tax.

My question is whether they can outlaw the nicotine juice. We can change the name of e-cigs, we can make our own PVs if we really have to, but creating an accurately measured concentration of nic juice at home would be problematic.
