Has anyone verified this? HR2058, yes. But that appropriations bill was delayed, and I believe it does carry over. Since the rider was already approved, I'm not 100% confident that this is accurate.From the latest CASAA newsletter:
Going into the 2016 election, the clear legislative strategy was to support including predicate date change language in the omnibus budget bill. Many expected the contents of an omnibus spending bill to be decided in early to mid-December. However, the incoming administration and Republican-controlled congress are making a decision to delay this until spring of 2017. As a result, the vehicle for the predicate date change language -- the Cole-Bishop amendment -- is no longer in play. However, there is still value in referencing the language when communicating with lawmakers on this issue.
Although modernizing the predicate date is not likely to happen this year, it is still a necessary step toward developing useful and fair regulation and support for this effort is ongoing. The larger effort will be focused on creating a separate category for low-risk products. With a more sympathetic government, developing this new regulatory regime is now more likely.
I hope it's not accurate. At the very least, we need that predicate date changed NOW! A lot of business decisions (and consumer, me) are riding on it. ProVape said if that date doesn't get changed, they'll go bye bye. Sure, a complete revocation of the deeming regs would be the ultimate but we need some sort of hope now. Saying we have more hope (while true) now that Trump won the election and the Republicans control Congress just doesn't cut it for me. We need something positive now! To you folks wondering about why ProVape may have disco'ed the build your own Radius...At the end of December another segment of the deeming kicks in, and manufacturers have to submit a complete listing of all products available to the FDA. A custom built mod has no place in such a description, because each variance from unit to unit makes them a distinctly different product.
As I see it, streamlining would be a necessary step to regulatory survival, and could also be viewed as an intent to stay in the game.
