It Isn't Splitting Hairs. It is making a Fundamental Determination of whether or not a Law applies to something.

Nicotine is Not tobacco. It can be Derived from tobacco. Or you can say that Nicotine can be Found in tobacco. But Nicotine is Not Tobacco.

So if a Law only applies to a product that Contains tobacco, an e-Liquid that contain Nicotine would not be Subject to that Law.

But where it Gets Ugly is when a Law(s) reference a "Tobacco Product". What Exactly is the Legal Definition of a Tobacco Product?

And the HUGE Question that has Lawyers/Legislators chomping at the bit is can a State use the Statutory Definition that the FDA has applied to include e-Cigarettes/e-Liquids as Tobacco Products, for the purpose of FDA Regulations, for the purpose of State Laws?

Many Argue that the FDA inclusion of e-Liquids that contain Nicotine derived from Tobacco Plants as Tobacco Products can be used by States. But also Argue that Nicotine that came from Other Sources or is Synthetic can Not. And the FDA's inclusion of Hardware or 0mg e-Liquids as Tobacco Products is Regulatory Overreach in the Purest Sense.

So it gets back to the HUGE Question. How far can a State apply the FDA's Definition of a Tobacco Product?

I believe that the Core of Tobacco Product Legal Challenges will be the wording from the FSTCA relating to "Derived From" tobacco.
Hope some listen to your cogent explanation.

Now nicotine is not a tobacco product but magically come 8/8/2016 just about everything vaping related will be classified a tobacco product.

I sincerely hope the FDA is stopped buf with our current crop of gutless politicians i don't have much hope. So i prepped just in case.

You are dead bang correct ..... The USA is already more socialistic than the old USSR was .... I have watched several interviews of soviet citizens who came here to vacation and all of them said they would never want to live here because of all the laws and restrictions.

I listen to a LOT of News and Talk radio.

It is very sad to here people who left Russia for freedom, and callers from The UK, Belgium, France, Australia, and others beg America nog to repeat their countries stupid mistakes

    Hey all.

    I picked up a bunch of kayfuns from Fast Tech and am impressed. The $7.78 kayfun V3 ES is as good as gold. It doesn't leak and it vapes perfectly. If someone told me that it was the original SvoMesto Kayfun 3 ES from 2013 I would have believed them.

    And that wasn't even the good one of the 4 different kayfun models I got. That was the cheapest one and the oldest version of the Kayfun. I haven't coiled up the lite, mini V3 or V4 as yet.

    Glad you are happy with your FT purchase. I have only had 2-3 disappointing items out of the few dozen orders.

    They have many good Kayfun attys.
    Mine was only $5.43 for a complete Kayfun clone.

    And the flavor from tge Goblin Mini, and Silverplay nano were less than $11 each a d tge flavor from those attys are nectar of the Gods.

    The 18650 cells in laptop batteries are generally NOT high-drain. That makes them dangerous to use in moderate or high powered devices. I would suggest cordless power tool battery packs as a much safer choice; they will have high-drain cell in them.
    Or just strip a Tesla ;)

    I'm still not entirely sure how the deeming regs will affect countries like Australia apart from the fact that the highest level of innovation, best juices and many good hardware components come from the US.

    I've been stockpiling liquids and nicotine mostly but so far, I think Aussies are safe with China nearby.

    My big concern is countries like Australia following suit with the draconian laws to try and destroy the industry as the US is doing.

    These last 2L make it 5L in the freezer ... there's no way I'm falling for the "don't worry" trumpeting I have seen ... I'm gonna sleep better tonight knowing I have this.

    No joking ... I can see Health Canada pushing to make possession of Nicotine base illegal here in Canada.

    Something along the line of environmental disaster pending BS

    All in all, I do believe we are going to see a full on attempt to hijack Vaping.

    And I'm warning people, too. Just looking for more clarification.
    When people say there is no need to prep and nothing to worry about that is when i prep so i don't have to worry. After all exactly how many treaties did the US Govt keep with the American Indians?

    If the Govt kept a peace treaty it was because the Indians had nothing the Govt wanted.

    For that price just get a few more Clones. Insure that you also get a few liters of 100mg nic in PG base and keep in the freezer. That is the base essentials you need.

    I'm very much hoping I'm wrong also, sad thing I don't believe we are. I believe that the best we can hope for is insane taxes and draconian regulations. It's all about the money and protection of the establishment

    Another thing to add, I started out on the Nautilus and it's a great tank. If you can afford it I can't recommend enough an Authentic SquapeRs. The build quality is amazing and the Vape is divine. The Clones of the Squape are complete crap though. But seriously the authentic will last a lifetime, the Swiss know how to build quality

    The best juices are actually made by individual people all over the world and not by companies. I personally feel that those that are in certain other countries (that I won't mention) won't have any problems shipping to the US. I would never vape any juice from China anyway and would always advise anyone - even now - not to do so.

    As far as hardware, people will go back to making devices like they did in the old days. Back when I started vaping, we were buy electrical components that weren't even designed for vaping and building better box mods than you could buy from any company. There's no way that they're going to be able to stop that. Send a friend a paypal and he'll send you a mod.
