Saw this story pop up today and thought I'd share.

Ruyan protects patents abroad

A couple interesting quote here:
The FDA on July 22 reported that a laboratory test of e-cigarette samples of other brands found that they contained carcinogens and toxic chemicals such as diethylene glycol, an ingredient used in antifreeze.
The two American brands tested by FDA are njoy and Smoking Everywhere. The former has been named in an IPR lawsuit initiated by Ruyn Group.
Looks like SE just makes friends everywhere they go.


"The battle with traditional cigarette makers is the thorniest issue," said Liu Debin, president of China International Tendering Co and chairman of Genertec Consulting Co Ltd, an international promotions partner of Ruyan since 2005.

"tobacco forces overseas are trying their best to suppress e-cigarettes by distributing rumors and urging governments -- the beneficiaries of tobacco taxes -- to establish high barriers to market entrance," Liu said. Liu said that e-cigarette manufacturers should not regard the product as substitutes, but complements to traditional tobacco.
In 2008, Ruyan reported HK$277.90 million in revenues for its atomizing cigarettes, reflecting a year-on-year growth rate of 105 percent.

So in other words, since the president of Njoy is also the president of the ECA, ECA funds will most likely go to help him pay off Ruyan instead of fighting for the rights of ecig users. Nevermind, it's not like they've been doing that anyway and I sure as hell wasn't stupid enough to donate money to a non-deductible business league like the ECA, so what do I care?

Wow, wish I bought stock in that company when they first came out.

The fact remains that e-cigs are hear to stay, and governments and ASH knows this. This is the reason for the which hunt by the FDA and the recent rabid attacks by ASH. A company that grows 105% per year that rakes in over a quarter of a billion dollars is not small potatoes. And that's in 2008.

So what about clinical trials? It sounds as if Ruyan has the bucks to underwrite testing. NJOY has a testing going on sponsored by NIH.

Potential reduced exposure products (PREPs) are being developed and marketed by the tobacco industry in an attempt to reduce some of the risks involved in tobacco use (see Breland et al., 2002b). Evaluating the effects of these products is crucial to public health, as past industry-sponsored efforts at harm reduction (e.g., so-called "light" and "ultra-light" cigarettes) were not evaluated and failed to reduce carbon monoxide (CO), nicotine, and carcinogen exposure in smokers; these efforts thus failed to reduce the harms of smoking (Stratton et al., 2001). This study is part of an on-going, NIH-funded program of research to develop a science-based model that uses outcome measures relevant to evaluating current tobacco industry-sponsored smoking harm reduction efforts systematically and efficiently.

Well if nearly 300 million dollars and a yearly growth rate of 105% from just Ruyan alone doesn't bother people with vested interest's in tobacco or tobacco cessation products...I don't know what will. It's no wonder the war is getting dirty.

Those are HK $ not USD. Takes about 7 HKD to buy one USD.... But the growth rate is impressive and I think will be exponential. I have about a 75% rate of smokers expressing an interest in mine and about 50% go out and buy one...

If I remember correctly, nJoy and Ruyan were in court because Ruyan was making slanderous/libelous statements against nJoy regarding the patent, which nJoy won. So nJoy isn't paying Ruyan anything and nJoy certainly couldn't use ECA funds to pay off anything if they were.

The ECA board would have to vote on something like that and they have done no such thing and wouldn't.

What's also completely intriguing to me is that didn't Ruyan admit to getting their liquids from Dekang? So to make the assumption that the testing done by the FDA does not affect their products and makes the "copycats" look bad, well, Ruyan should probably pick a new manufacturer for liquid. :)

Thats still a $38-39 million dollar increase in a short time frame, and definitely an impressive growth - while having many competitors springing up

VocalEK - I don't know if nJoy is contributing to this. I know that the NCI and NIDA is paying for it. I will find out if they are though. It's hard to tell if their product (as well as Crown 7's) was purchased, donated, taken from seized shipments or what for the study. And I don't know if Crown 7 has anything seized. But, when I get an answer I will let you know. :)
