The Court of Appeals dissolved its March 31st stay of Judge Leon's injunction. In English, Judge Leon (District Court) issued an preliminary injunction against the FDA, telling it that it could no longer seize njoy and SE's shipments while the case was being heard.

The FDA appealed Judge Leon's grant of the preliminary injunction to the Court of Appeals. The Court of Appeals said that until it actually had time to fully consider the issues, Judge Leon's injunction would be stayed (put on hold).

The Court of Appeals has now dissolved that stay, effectively making Judge Leon's preliminary injunction once again in full force and effect.

I've got a steel van de Stadt 37 in fit-out at the moment. Nothing like a sailboat eh?

Nice boats the vander Stadts, strong and can go virtually anywhere.

Yeah it's a lot of work. Have completely rebuilt her over the past few years. Big refit in 2000, new laid deck (White Beech with Jarrah kingplanks) new cockpit & cabin trunking and a complete re-fit down below. She is beautiful though.

I used to crew on a Thistle for regattas on Lake Erie. I once was pretty good at hiking.

I must admit my days of racing are waning, mainly just Twighlights now, and nothing that causes the Chardonnay to spill. :laugh:

I'm more involved in race management, currently working towards my international accreditation (takes years unfortunately).

Thank you, Julie. Isn't the time that the FDA can appeal, just about run out ??

Not particularly good sailing here in the midwest, both due to the weather as well as the fundamental lack of oceans. :)

No news on the docket.

As for the appeal deadlines, I'm really not sure. I know that the FDA has a certain amount of time to request a rehearing or an appeal to the Supreme Court. Maybe that is the 7 days that is referenced. I would have thought it'd be longer, but maybe because this is an interlocutory appeal, there's a shorter deadline.

I'll send a PM to Yvilla and ask if she can shed some light on this.
