With all due respect, some of you are most definitely outside of your areas of expertise by a very long distance and sound like kids going off in the wrong direction against the established backdrop of the FAMILY SMOKING PREVENTION AND tobacco CONTROL ACT and SOTTERA, INC. v. FOOD & DRUG ADMINISTRATION.-.Argued September 23, 2010. If Totally Wicked wants to get run out of the USA market, then they'll keep their cartoon advertising. This is really not up to much discussion unless you are trained in the law and have substantial experience. Mark my words, TW is going waste a lot of unnecessary time and money on litigation expense if they want to continue doing USA business with a cartoon website/advertising, disclaimers notwithstanding.

TW is an UK based company, they are neither stubborn nor stupid. The UK is not .... about adult cartoon based themes like this country is, who thinks that they have the right to control our every thought and action. I'm beginning to think this is no longer the USA but the CSA (Communist States of America).

With all due respect, if you are a lawyer, why not just disclose that rather than berate and belittle folks?

For the record, I have a soft spot for devils being that my alma mater is Duke. Moreover, I enjoy graphic novels (comic books sounds so juvenile :p), although as the price of them has climbed, my interest has waned. That being said, whether one thinks that it is reasonable or fair, cartoon advertising for tobacco products is not a good thing in the U.S.

While I agree that TW's cartoon character will be problematic for TW, it really shouldn't have any bearing on the instant lawsuit. And I suspect now that TW has good counsel here in the U.S., TW will start to appreciate the problems associated with using cartoon characters in advertising.

Perhaps lawyers have a right to be arrogant? After all, they seem to control much of our daily lives, and the trademark of power is arrogance.

It's nice to see someone with absolute conviction about the validity of their opinions, though it pays to be right in the end, to avoid looking foolish.

Dear me Jerry, that is unfortunate. Perhaps she just has the arrogance and rudeness of youth? Many of us were guilty of that, so perhaps it's lucky the only punishment is the quiet amusement of their elders.

However, some lawyers are supposed to be quite pleasant - allegedly. This is, of course, only hearsay.

My cousin is a lawyer and he is one of the nicest guys you every would want to meet. I think lawyers are much like the rest of us. Some are arrogant, some are modest. Some are rude, some are considerate and helpful. Some are tall, some are short... I think you get the idea.

She is middle age, Chris and Elaine. She never married and was living at home with her parents, she became so bad, that her dying mother threw her out of the house. Her father no longer has any contact with her. When I would try to have a conversation with her, (not about anything legal, just talk), she would walk away from me.

I haven't had much contact with lawyers, but I hope that she is the exception and not the rule.

Substitute the lawyers with politicians.

LOL ... I'll go you one better, substitute them all with some of those FDA think they are gods people.

Delicacy sometimes translates into stupidity, short-sightedness and inaction. If ECF's members were on top of their game, they would quickly tell TW to jump off a cliff if they don't ditch their cartoon advertising. Some of you seem to have no idea how precarious a position the nic juice industry is in. However, if you do, and you still "support" TW, then you need to up your strategic IQ substantially. Now for those of you who did not read my earlier post, and therefore are jumping in with absurd off-point comments, I said, "Totally Wicked always is going to have a regulatory problem of some sort ... " The full flavor, as it were, of those regulatory problems need not occur in the instant lawsuit, but some of them might. Indeed, TW could be regulated completely out of the USA-market in short order regardless of the outcome of the present lawsuit. Now I apologize if I offended your delicate sensibilities, but time is quickly running out, and this is not the time for unmistakable amateurs encouraging TW contrary to our collective self-interests. Oh, by the way, if you still don't like my remarks, then ask for a refund. Duke-braggart, here is one for you: I didn't bother applying there. It was too low on the list of top schools. That is the truth. Sorry.
