Small ejuice companies: Mount Up

I read the NBC article on the FDA proposal and it sickened me to see the big e-cigarette companies and the "Big 3" practically gloat at the regulations because it all but assures them a place at the table, while it pushes the small companies or what they call "Johnny come lately's" out by using a muddled and costly application process .

It was like the FDA and big tobacco sat down and the FDA gave Big Tobacco a sloppy [explicit], and massage their [radio edit]!

The only loop hole I see is that they aren't regulating 0mg juice. If the smaller companies can form a collective and apply for 1 nicotine based non flavored e-liquid than they should be able to sell those products separately and let the consumer mix to their nicotine strengthen.

That's an interesting idea. I have thought they might be able to regulate ONLY the nicotine. Not the hardware, or 0mg liquids. That has nothing to do with tobacco, if you catch my drift.

They can regulate atomizers for sure but mods themselves are not the container that hold the nicotine. I am not sure they could regulate those, but tanks, cartos and even rdas hold the nicotine so the can be regulate.

I see your idea. It sounds good, sell unflavored nicotine at certain levels and then sell premixed flavorings that customers can add.

If this continues, and prices are increased as tax revenue, how many will go back to the analogs due to price? My analogs, when I RYO'd, were about $1.25 per pack...Regulations bring price increases.

With any luck the new fda regs as they apply to manufacture of eliquid will be more like food regs than cigarette. I don't think that oreo had to submit new applications for double stuff since it is the same ingredients used in different quantities, juice should be the same. As long as ingredients are approved should not be too much a concern for the deal eliquid manufacturers. Bakeries don't have to get additional licences for every cupcake recipe so i don't think we will be in to bad of shape

I hate to rain on anybody's parade, but I urge you NOT to be optimistic about what FDA will do. Do NOT look at this proposed rule logically or in the fairest or best possible light.

If you want to see exactly how FDA has been regulating cigarettes, hop over to their website, and take a gander at their guidelines for Substantial Equivalency and Pre-Market Authorization applications. This is how they will deal with ecigs.

If you are unfamiliar with the FDA Center for Tobacco Products, check out the Media and Legislative forums here.

Be prepared for them to try to regulate *every* component to an ecig, not just eliquid. Don't think they won't because "it doesn't make sense for them to do so." If they think they can get away with it, they'll try. If their lawyers tell them such attempts will survive the inevitable court battle, they'll try.

The FDA is NOT your friend, they do NOT have your best interests at heart. They are NOT about public health.

Exactly, the FDA nor our government have ANY interest in protecting you or anything you care about. They do not have our best interests in mind. They need to protect all those corporations that pay them money, because well...they are people too damnit!

What about all the smokers that would not be introduced to E-cigs? I am thinking of my grandchildren that MIGHT start smoking since most everyone in my family did. I am thinking of my great grandchildren who might be smokers that could have potentially never been smokers if ecigs are still available in future years.

Those are the ones that I want to make sure that have the capability of finding these.

No its not. Absinthe was illegal for years but that doesnt mean you cant label it as something else when selling it online.
