Well

In my mystery fruit cocktail I just added cherry, passion fruit and watermelon. @6% total flavoring, it's still VERY obviously a fruity flavor on exhale.

I would assume someone would have to smell it unless the liquid in your tank is dark.

Unless they're going to confiscate your juice and have a spectrum analysis done on it, I don't think a statement of "it smelled fruity" would hold up in court. You could just use the defense that it wasn't your vape they was smelling, it was your perfume.

The ban would be for sales, they wouldn't bother individuals.

I'm curious how they would even enforce such a ban without singling out vape shops, which would be open for a lawsuit.
They way it's written, menthol cigarettes are now illegal to sell, as well as flavored cigars.
This will get interesting, as it will definitely get challenged.

Doesn't work that way with other stuff. Simple to train a cop and certify him to know the difference between pg, vg, nic base and the only constituent that smells like... A flavor... flavoring.

Confiscating the tank, the bottle or the atty would do just fine.

Adults can't do what they want if you have banned the products for adults to purchase, the law was already there for no under 18's and you just put laws on top of existing laws instead of enforcing the first one.

So they are not banning flavors they are banning the sales of ecigarettes... period...

"After months of discussion, council members Monday approved a measure that will not only prohibit new businesses from selling cigarettes, cigars, chewing tobacco and other products, but also ban the sale of e-cigarettes, cheap cigars and most flavored tobacco in town."

and it does look like there was some (applause) who put on their boots....

"The council heard from about 20 people on the issue Monday. Several were tobacco and e-cigarette retailers and came from all over the county and Northern California. They argued it was unfair to bundle e-cigarettes with other tobacco products and restrict their sale in town. However, council members said they wanted those devices off store shelves because of their growing popularity among children."

I live in CA, this is very sad to hear. California has always (or is now) been a "pre-cursor" to the rest of the nation. We are a "blue" state, and while the leaders of this nation are "blue", the nation will follow California's lead. I can't even use lead bullets to hunt anymore! What the eff is that? It's California, friends. Attack the good people to stop the bad people. Great way of doing things, lol.
Oh, this is not a political thing for me, I am not trying to bring in politics(not in depth) so please nobody be mad or offended. But CA and NY are getting more and more ridiculous with their laws. I know I'll be moving away in the future, as will many good people. Because of laws like this. It's a shame, cus when it comes down to it, it's all about the money. Our health and lives will be jeopardized for BT's money. But what's new I guess....
