The Alien Vapors vs AVE issue...

Maybe I should post this under the "General e-liquid Discussion" sub, but it's kind of a general-vaping issue. I think it is, anyway.

This issue really pisses me off. Everyone reads about Boba's Bounty, and that it's yum yums. Then, newbs go to buy a bottle and WITHOUT FAIL buy it from Alien Vapors, only to be told, "that's not the right one". Can't we get a sticky around here, like on the front page or something, alerting new users to this fact? I thought about the whole legal argument, where if a sticky got placed stating that the Alien Vapors Boba's was a cheap knockoff, then they could take issue with it. I know the Alien Vapors registered the name, but wouldn't AVE have historical and community support to fight any claims by the Alien Vapors people.

It happened to me when I FIRST started (2+ months ago). Luckily I only ordered 10ml, just to try it. It just happened to my uncle, who just started vaping last week. He tried mine, and had to have his own I guess (he bought 30ml. Ugh). I didn't realize he was going to order it right away, as I'd told him I'd send him a link - not remembering that Alien Vapors comes up first when you Google Boba's. I mean, we should do SOMETHING to combat that nonsense. Am I right? It's FRAUD, damnit!

That fact that they have the same name is pretty lame though.

That's the real issue. Other places say their liquid is a clone. And as far as MODs go, almost all of them say they are a clone, and you KNOW it's a clone when you buy it. Alien Vapers doesn't say that. They're outright STEALING from from AVE, and defrauding the people that buy from them. Ethics, people. Ethics.

Ever heard of RY4 ? was Dekang, Hagsen, Ruyan or someone else the originator?
How many reputable juice suppliers make a copy/version of ry4 and name their version ry4,,, almost all of them.
Same goes for most if not all popular flavors.

Not everyone agrees that AVE's boba's bounty is anything special or even good.
If push came to shove seems the one that registered the name would have the rights to the name if there were any such thing.

Fraud, no. Shady business practice, maybe, Business as usual for ejuice makers, yes.
Flavor names have been ripped off for as long as ejuice has been around.

This is no different than with Vivi Nova tank systems. Vision is the original but Smoktech copied the design, the name and even the packaging to the point that unless you know exactly what to look for, you won't know the difference other than the bonus problems and sub-par performance that you get from the Smoktech version.

I am surprised that Disney hasn't already sent AVE a C&D. Boba Fett is a registered trademark. I don't know if they still have the picture of him on their site but that would bury any legal defense they might have had if they do. The name 'boba' isn't owned by Disney, but the name 'boba fett' and his likeness is.

Alien Visions is the real deal, also called AVE around here. Have no idea how that happened.

Anyway, I'm pretty new to vaping myself and got robbed by Alien Vapors just a few days ago by this. I heard about Boba's Bounty from a friend and I knew the maker had Alien in the name. He told me it was hard to get so I was surprised when I was able to buy it no problems, from Alien Vapors of course. It was later that night my wife and I were talking about it that made me think I could have bought a clone. Sure enough I did. Lucky I only got 10ml, and it showed up yesterday. I don't know, it tastes like a damn Tootsie Roll to me. Still waiting on the AVE Boba's Bounty to show up, hopefully I'll get it today!

AVEJuice is the right site. Man it's pretty disgusting that we even have to say that.

No this is not the same, if someone made a clone recipe of boba's and called it something else that would be fine. The Smok tank is not called a Vivi Nova, that would be a trademark infringement (if it were enforceable).

The issue here is the fact that Boba's Bounty is an established trademark. It is critical to the identification of the juice and this other company using the mark is not kosher at all. Being that both companies are in the US something CAN be done about it. IMO AVE has more than enough income to put a lawyer on the case.

I saw that. AVE has rights to the trademark having used it in commerce first. This was really a stupid move by the counterfeiter, and if AVE doesn't just blow it, should result in AVE owning the registered trademark.

wait a sec, does this mean that if alien vapors wanted to c&d alien vision's bobas bounty name they could?

im all up for people making clones of equipment, hell some clone batteries and stuff are better than the original or marginally close and more widely aviable.
on this thread i have just heard about "alien vapors" and their probably crap juice. making a clone of a juice and keeping the damn name is pretty low. this is the kinda s**t you'd expect from a politician.
