Sorry, that was really bugging me.

I don't see why it's that big of a deal.. There are plenty (I'd say the vape market is pretty saturated right now) other vendors. It's not that I don't doubt there are fine vendors on eBay, but there are reliable storefront pages setup specifically for this kind of thing. They'll QA, they'll take returns, they'll answer customer support.. Why wouldn't you take advantage of that virtually guaranteed reliability?

No wonder they breed potential politicians at ebay. This is a snippet of the text contained in a email a friend of mine got over the weekend:

Due to strict government regulations, eBay doesn't allow the sale of most tobacco products. This includes cigarettes, cigars, herbal cigarettes, and smokeless tobacco. E-cigarettes also aren’t allowed on eBay. We realize e-cigarettes don’t contain tobacco. But due to a lack of globally consistent or clearly established regulations for the sale of these items, eBay has made the decision to not allow the sale of e-cigarettes or their components.

I have recieved that same message and have had 2 listings removed by eBay for that rule. I was selling a Nautilus Mini in one, and Aspire BVCs in another. neither of which are a tobacco product, or an e-cigarrette, and contained no nicotine.

However if you type "atomizer" into the eBay search bar, 2500 listings come up and include sellers who have sold hundreds of RBAs on eBay. I asked for a rule clarification, but I only got a form response. The rule clearly states that "atomizer" is a banned product.

Wonder if this Comical Ebay whining crap will ever stop.

First - the TOS is their structure and any seller is obligated to know and follow the TOS
Second - they are a Company and can set any conditions they wish. Has nothing to do with what any individual wants.
Third - they come under the same scrutiny as we do and wish not to be on the negative side of persecution.
Forth - they have clear cut work arounds for the TOC for Vapors supplies.

Blame the Venders using poor wording
The suppliers(Aspire) for reporting their products as FOR E-cigarette use - to appease their venders
Blame Venders and ANTZ for reporting listings - requiring Ebay to take action.

However if you type "atomizer" into the eBay search bar, 2500 listings come up and include sellers who have sold hundreds of RBAs on eBay. I asked for a rule clarification, but I only got a form response. The rule clearly states that "atomizer" is a banned product.

BS comment - Atomizer is related to to many items outside of Vaping and therefor allowed:facepalm:
The use of the word in improper context may be NOT allowed.
Check catagories of each to see why

Uh oh.... so I just purchased a eleaf gs air last night on Ebay....should I be concerned?

You should be fine. The seller will get an email a couple of days after the auction ended, informing them it was removed because it violated a policy, or they won't...it's rather inconsistent. The seller will still ship it to you, you just won't be able to track it or leave feedback for it through eBay.

At least that has been my experience with the whole ordeal.

I tried that. It didnt matter. I even added a disclaimer stating the item was not tobacco, nicotine, or ecig. Stated it was an accesory for APVs and that no one under 18 could bid.

No adult only products are allowed in the main portion of Ebay. This may have been your issue. Aspire may have been the trigger word due to Paypal. Something you were doing was a trigger.
I deal with a few reputable suppliers that offer better pricing through ebay sales and have never had an issue.
My son has made half a dozen Vape related purchases in the past few weeks with no problems in purchase or tracking.

Doing business on Ebay is an art unto itself.

I recently bought a battery on ebay because it was a good price, had free shipping, and the seller had a ton of positives. It came a couple of weeks ago. Yesterday I wen to My Ebay to check tracking on another purchase (not vaping related) and the following message showed up where the item I purchased had been.

We had to remove this listing from the site and you're not required to complete the transaction. If you've already sent payment, the sale should process as normal and you don't have anything to worry about. If you have any questions about delivery, please check tracking or contact your seller. If you run into any trouble along the way eBay is here to help. Please visit the Resolution Center to help resolve any problems you may encounter.

Yes, some people still sell ecig stuff on Ebay but I know from experience that they will get removed, it is just a matter of time. Really stupid. Amazon bans ecig stuff as well and Facebook does not let you promote ecig stuff either.

Nothing like a crap fest of miss-information.
Acres of E-cig Vendors and Manufacturers on Facebook.

Amazon e-cig search - start browsing:
Amazon.com: e-cig

Give it a rest. This is not news it is business covering their Political butts.
Profits are of Number one concern in business and you do not make profits by pissing off the main stream.
A little perceived cooperation allows both sides to win and the Business to deal with business at hand, not waste profits battling idiots.

Ebay could easily wipe out sales through Bot control. They instead choose to maneuver to serve their shoppers in a careful manor only flexing power when required by some negative event.
You may notice no Shopper has been banned for purchasing banned merchandise even though they(we) are supposed to know and agreed to their TOS.

My disclaimer was based on other (successful) sellers disclaimer. Thats why I added the 18 part.

I wouldn't be. I've bought a good amount of vaping stuff on e-bay and always got what I ordered.I have noticed that suppliers I bought from in the past are only selling batteries and what not.I tried to sell 2 mods on there about a month ago and e-bay cancelled them both.Violation of no tobacco and e-cig policy.I called them about it and the said I was randomly audited, but that they are cracking down on anything e-cig related.

You brought attention to your listing by using the terms tobacco, nicotine and ecig. I've sold (2) box mods and (1) mech mod without incident on ebay. I just use my wording very carefully in my item's description and I NEVER use wording (ecig terms) that can trigger a response by ebay.

That could be. The first listing had no mention of any of it. Just the Nautilus Mini for sale. It got pulled along with a email from ebay.

So i studied many successful sellers of vape gear. I noticed that most had a disclaimer about the product not being tobacco, nicotine, no sales under 18, etc, so I copied the basic disclaimer and used it for a second, but different listing (BVC coils). It also got pulled and a second email sent.

The email specifically mentioned that "atomizers" were a banned item. I searched "atomizer" and saw over 2500 listings. I contacted eBay about this discrepency, but only recieved a form letter stating the policy.

BTW, im not complaining about it. I have since traded the items here at ecf. Im just adding to the discussion.

After reviewing your eBay account, it looks like you haven’t followed our Tobacco Products policy. We understand that you may not have been aware of this policy or that this may have been an oversight, so we're including some policy information to help you with your future listings. We also had to take the following actions:
- Listings that didn't follow eBay guidelines have been removed. A list of removed items is available further down in this email.
- We have credited all associated fees except for the final value fee for your listing(s)..

But due to a lack of globally consistent or clearly established regulations for the sale of these items, eBay has made the decision to not allow the sale of e-cigarettes or their components.

.

You may sell collectible packaging that contains tobacco if the package is unopened and the required tobacco statements are included in your listing..

.

The following items are not considered collectibles, and they are not allowed to be listed or sold on eBay:

- Cigars in cellophane wrapping.

- Collectible tobacco, including a listing that describes the tobacco instead of its collectible packaging.

- Tobacco products packaged in classic packaging.

.

If you include photos in your listing, you need to display the actual item for sale. Stock photos are not allowed.

.

For more information on this policy and disclaimers required for collectibles, go to:

Tobacco policy

You listed an accessory for an electronic cigarette. Based on a warning and requests from the FDA, eBay decided not to allow e-Cigarettes or their accessories on the site. This includes batteries, e-juice, atomizers, etc. for items that are e-Cigarettes by name or by manufacturer classification. While we appreciate that you have chosen to utilize our site, we must ask that you please not relist in this case.
