The legal future of ecigs in the States

I have been a bit worried about some of the chatter that I've been hearing about the potential ban on ecigs and nicotine containing products here in the States. How real is this threat? Is there more reading I can do on the subject? Are vendors doing anything in anticipation of a ban/regulation? I'd hate to find myself without my precious ejuice and cartos :(

I can easily see a crack down coming, hard. No way big tobacco just watches, you would be crazy to think that. 1000's of lawyers at the ready and working already

that's what i thought at first, but tobacco really isn't the threat. if anything they missed the chance to get in on this market. pharma on the other hand has deep pockets and is willing to fight. they lost the first round, but expect them to come back with a vengeance.

Ah but that was a HUGE LOSS and a legal precedent which IMO is Great for US all! Had it gone their way......well we'd not likely be on here right now

The FDA were defeated in their attempt to ban e-cigs. However, that is not the end of the story, as they are paid to try to kill them off. What will come next is a gradual trial of strength between the trade and community vs the pharmaceutical industry (the FDA) in court, as numerous restrictions are tried in order to try to limit the attractiveness of e-cigs as compared to the pharma products whose sales will be curtailed as a result of the popularity of e-cigs.

But please don't worry at this time, you will have plenty of notice of any problems, as they arise. There is a long way to go yet before the pharma industry succeed in any of their little ploys. Some epic battles ahead, no doubt.

yep. i like judicial tenure. and i love how appointees from the past, from both sides, stay around to keep political insanity in check. comforts me that our system isn't totally fubar.

No, the e-cig approval war isn’t won. Neither will it be lost in the next few days.

In the meantime, for those that haven't checked the other threads around here, the grassroots battle big pharma is trying is as insidious as their commercials that soothingly drone on the devastating side-effects of their newest up-and-coming drug.

They have morphed anti-smoking into anti-tobacco. Don't fool yourselves to think this was incidental or accidental...they did this for the very purpose of including e-liquid in their campaigns. They do this to pave the way in changing the policies that were anti-smoking to anti-tobacco. In this way they will sneak up behind us all, and slowly, bit by bit, remove our rights to vape where we wish. It has happened in Boston, it has happened in California, it may come to your state or town next.

We simply have to enforce for ourselves the difference between SMOKING and TOBACCO. Yes, I use a tobacco product. NO, I do not smoke!! Make this distinction as often an as vocally as you can.

I would love for you and any other new members who stumble into these conflicts to please get involved! Sign up to join CASAA, write letters to the newspapers that publish mindless propaganda condemning e-cigs, notify your congressman and state representatives of how wonderful e-cigarettes are! We are a relatively small community when compared to the total populace of the US, and I fear if we do not become enough of a squeaky wheel, our rights to vape will be slowly but surely trampled…one town, then one state at a time!!!

It's actually worse than that, if you can believe it.

They went from anti-smoking to anti-tobacco.
And now they are going from anti-tobacco to anti-nicotine.

I'm not sure of the history, but I assume they went to anti-tobacco because of the relative safety and effectiveness of snus in Sweden.
And now they are going to anti-nicotine because of the relative safety and effectiveness of things like e-cigs and dissolvables.

They keep moving the target as their previous target becomes potentially attainable.
That's because their real goal is not to reach their target, but to sustain their existence.

And it seems they don't care if we all die in the process.

The only thing that I see them pulling off, and being able to make stick, is a ban on mail order of nicotine juice. I'm prepared. I have years worth of nic concentrate.

I do too, though I'm hopeful I won't need to rely on it anytime soon (as my DIY skills thusfar are as lousy as my cooking). Back when the threat seemed more ominous, I decided that I was only going to have equipment that used non-proprietary batteries, and that I'd also have a rebuildable atomizer. So I think I'm pretty ready for a doomsday that will hopefully never come.

Yeah most likely you will still be able to buy everything that doesn't contain nic and even if they do I have the skills and enough parts (been keeping everything in parts bags for tinkering) to keep me going for quite awhile..about 30' of NiChrome wire should last awhile when it only takes about 1" to rebuild carts/atomizers..I might have to go to the reservation buy native tobacco and learn how to make my own nic..unless I enjoy vaping without nic and I might..I have a 30ml 0nic bottle of my fav on the way as I type this too :)

i hear you. at this point i've mastered the unflavored 50/50 pg/vg. feels like i'm back in high school chemistry. same erlenmeyer flask, pipet and dumb look on my face.

that's what really irks me about the fda position. you really want people doing this themselves? it's totally unnecessary. there are experts who can do it well, safely and at lower cost.

although i have to say i'm fascinated about the alternative vegetable nicotine sources. part of me hopes they press on and ban liquid sales outright. the ban would ultimately be self defeating and the result would be a flowering of development in the alternatives.
