(7) to continue to permit the sale of tobacco products to adults in conjunction with measures to ensure that they are not sold or accessible to underage purchasers;

Also please note:
(3) LIMITATION ON POWER GRANTED TO THE FOOD AND DRUG ADMINISTRATION- Because of the importance of a decision of the Secretary to issue a regulation--

‘(A) banning all cigarettes, all smokeless tobacco products, all little cigars, all cigars other than little cigars, all pipe tobacco, or all roll-your-own tobacco products; or
‘(B) requiring the reduction of nicotine yields of a tobacco product to zero,

the Secretary is prohibited from taking such actions under this Act.

In other words they could limit cigarettes to 1/10th of the current nicotine levels and still comply with the regulations.

That would cause people to smoke more, scary indeed...
 
Um, the bill says that the secretary is forbidden to ban sales of tobacco products or limit nicotine to zero. This is actually good news.

I wouldn't go so far as to call the Tobacco Act "good news", but it is the reason that it is a good thing that the FDA can only regulate products like e-cigarettes that contain nicotine derived from tobacco and do not make health claims in their marketing as tobacco products (unless approved by the FDA as modified risk).

Yeah, this is why the FDA has recently purchased a truckload of "XXI Century" brand cigarettes containing varying levels of nicotine. They HOPE to prove that if smokers are given cigarettes with nearly no nicotine that they will get frustrated and quit smoking and not just smoke more or take longer, more dangerous, puffs. If the FDA can prove that low nicotine cigarettes help people quit, they can justify a requirement for manufacturers to reduce the nicotine content of tobacco.

Ironically, the same company is also attempting to get cigarettes with INCREASED nicotine approved under the "modified risk" category if they can prove that high nicotine cigarette smokers will smoke fewer cigarettes.

We will eventually be reduced to DIY to support our nicotine addiction.

I don't have a nicotine addiction. I have a fidgeting "disorder," which partly presents as a hand-mouth addiction (also nail/cuticle picking, hair twirling, restless leg syndrome and eating), which e-cigarette use alleviates and the nicotine is just a perk. If e-cigarettes were banned tomorrow, I know I'd compensate with eating, weigh 1,000 lbs and have a heart attack or diabetes. Or I'd start smoking again, because even smokeless doesn't do it for me, in spite of the higher nicotine content. I need the hand-mouth thing.

I suspect I'm not alone in this.

Not so crazy. It worked for me. Switching from "Lights" to the brand with the highest amount of nicotine I could find (American Spirit), allowed me to cut the number of cigarettes I smoked in half.

The Supreme Court ruling in Brown & Williamson vs FDA that was used by Judge Leon and the entire DC Appeals Court for their basis to determine that recreational nicotine products that do not make health claims can only be regulated as tobacco products was a result of the FDA accusing B&W of "making cigarettes more addictive" because they had added Y1 Tobacco that contains around 6.5% nicotine (65mg/g) to reduce the amount of "tar" (the name for the sticky conglomerate of partially combusted nicotine and other tobacco alkaloids) in cigarettes.

Kind of ironic that when a tobacco company responds to one complaint, they get accused of something else. When test-marketing Camel orbs, there were complaints about the original design of the container. The complaints pointed out that it was possible to shake out more than one orb at a time.

So RJR went back and redesigned the package. The new design is so difficult to open that now the complaint is that BECAUSE it is so difficult to open, parents may leave it open and lying around where kids could get their hands on the product.

I think everyone has known for a long time that the best way to open a milk carton is to attack it with scissors or a knife - or just shoot it. The opener spout can only be operated by children, just like video players and DVD recorders.

Adults have to remove childproof caps with an angle grinder or Dremel cutting tool, unless a child is available to open them.
