Why do these have to be considered either? Nicotine is a drug, but is it only a MEDICINE?

Caffeine is a drug, but it's not considered a medicine. Soda cans aren't considered a medical device to deliver caffeine to stop drinking coffee. Not all caffeine-containing products must be classified as a "coffee product." Why must liquid nicotine be considered either a tobacco product or a medical product? Alcohol is used in medical applications (Nyquil), yet beer tappers aren't considered medical devices.

Why can't it be called what it is? Recreational Nicotine.

You make one helluva case right there !!!!! Just think of the repercussions if a device to consume liquid form nic and the device to deliver the product is deemed a "delivery device" . The can would also be in that category, then the bottle of shampoo, and so on to enormous extent.

This could also be something of an appeal.

This is entirely the point that I am confused about too..

It makes no sense and I still think in the back of my mind, that none of this would have happened with the FDA if those two dang companys didn't spout out saying that if you vape you can quit smoking (Once a person starts it's obvious that you can quit if you want.. Didn't need to make it public).. That's what got all of us up the creek with the FDA...

If they didn't go off and claim that, this would have been fine, at least until so many people vaped it was out in the open, full view.. As long as people drifted into knowing about the e-ciggies by themselves (quietly), and all of us still had to explain what we were doing in public to people and passed on the knowledge of vaping these, the FDA wouldn't have noticed..

Today, November 19, is the day that it's going to be considered by the Senate Committee. :?:

I really really wish my spells worked properly for some senator to have an "attack" and they would have to cancel it today...

Not only are we screwed but the Postal Service (Pact Act 2003 caused them to lose 140 million already), The Native Americans are screwed again (what else is new), and we all are in a mess.. Look at all the e-ciggie companys, analog companys, Hookah companys online folding for they can't send this stuff.. I'm totally disgusted.. If anyone goes off at me about how I have to be a "Proud American", I'll shove a red, white, and blue flag up them sideways!

I was hoping for maybe a minor earthquake, that would force them to evacuate the building, but that would only delay the inevitable!

Jerry that's goooooood, didn't even think of that.. Love it *LOL* Could ya' just imagine all of them swaying around helplessly.. Falling down..... and go "BOOM!*! *LOL*

Here's the membership of the tobacco industry organized Coalition to Stop Contraband Tobacco (which is organized by AWMA and Altria)Members | Coalition to Stop Contraband Tobacco

The well funded anti-tobacco organizations (CTFK, ACS, AHA, ALA) have been lobbying to enact the PACT Act for the past four or five years. Since Altria, AWMA and lots of other tobacco industry groups are now lobbying for the PACT Act, I suspect it will pass today's Senate Judiciary Cmte markup. But that doesn't necessarily mean it will be approved by the full Senate this session, as they've got a lot more pressing issues on their plate for the near future.

Last year, RJ Reynolds lobbied against the PACT Act, and got Rep. Peter King (R-NY) to issue a GOP House report claiming that the best way to reduce cigarette smuggling was to reduce cigarette tax rates.

In a previous post last week, I indicated that e-cigarettes might be categorized as smokeless tobacco products if/when the FDA decided to redefine e-cigarettes as tobacco products. But the FDA also now has the authority to establish a new category of tobacco product for e-cigarettes, which is what I urged US Congress to amend the FDA tobacco legislation to do.

So it is uncertain whether or not the FDA would define e-cigarettes as a smokeless tobacco product (if it chose to define e-cigarettes as tobacco products).

I was just advised this is the skivvy on the PACT Act:

"It still must go through the Srnat Finance Committee, the Senate floor, the House Ways and Means Committee, the House Health subcomittee, the House Floor, Conference Committee, and then signed by the president before it can become law. That is a lot of ifs."

I feel much better now :D

It's clear that this bill will pass the Senate. And Obama, smoker or not, will sign it into law. I am 100% sure of that. But it seems pretty clear that the language of the law omits electronic cigarettes and nicotine juices. They are not tobacco products under the letter of this law. If the bill passes and the Feds start cracking down on e-cigs and juice shipments through the USPS, I think the e-cig industry could have a lawsuit on their hands. We can only hope some ACLU lawyer likes to vape!

Of course, if the FDA decides to classify e-cigs as a tobacco product, then we're all screwed. I think, either way, it's time to seriously stock up on as much as you can afford in the way of juice, atomizers, extra batteries, carts, etc.

But in the meantime, even if this bill passes into law, I would hope that e-cig and juice companies in the US will continue to operate as usual in protest of this foolish law.
