What exactly does a smoking ban cover?

I have been doing a lot of research on smoking bans and exactly what the government's definition of "smoke" really is. I have searched through some legal documents and the ones I have read say the act of smoking is banned and do not mention anything about smoking something that is combustible (if combustibles are mentioned than ecigs are not covered by the ban). There are many definitions of the word smoking and none of the bans state which definition they are covering. Below is the one of the many definitions of smoking.

Smoking(verb)- to send forth steam or vapor, dust, or the like.

So in my opinion this does cover electronic cigarettes... BUT WAIT what else does this cover?

Breathe(verb)- to take air, oxygen, etc., into the lungs and expel it; inhale and exhale; respire.

Boil(verb)- to change from a liquid to a gaseous state, producing bubbles of gas that rise to the surface of the liquid, agitating it as they rise.

Fart(verb)- to expel intestinal gas from the anus; to break wind

Belch(verb)- to eject gas spasmodically and noisily from the stomach through the mouth; eruct.

So if you are in an area that is covered by a non-smoking ban... you may not breathe, boil a liquid, fart, or belch.

So if anyone tells you that electronic cigarettes are included in a non-smoking ban than respond by saying.. well so is breathing so hold your breath!(not really.. dont be rude ;))

Of course the owner of a private business, a restaurant for example, does have the final say over what you can and can't do on their property so take that into consideration, but the purpose of this post was to show that if PVs are covered by smoking bans than so is breathing!

I want to emphasize that I'm not telling people to actually go out and get caught vaping and argue this point with people (this could give ecigs a bad name) I just thought it'd be some good info!

Smoking bans are passed at the state or local level. So while in Virginia, we have a ruling from the commonwealth's Attorney General that (as currently worded) inhaling/exhaling vapor is not included in the ban, your state or local law may be worded differently.

Quick reference: You can select your state and see whether e-cigarettes are included in any bans.
