Can we compare these two acts:
1. Minor drinking O'Doul's
2. Minor vaping on 0 mg nic

Would it be not against the law in both cases or just the first one?

The kid would still be carded for O'Douls. But if you're drinking cheap beer for the taste and not the buzz then YOU'RE DOING IT WRONG.

you people are all missing the key point, it is not illegal for under 18 to vape, or smoke, where the legalities lie is in the selling of products to minors. If a store sells or an adult buys cigarettes for a minor the store or the adult faces charges, not the minor for smoking. Can't believe this got by all you people, i thought vaping made you smarter....lol, and to erictho read the law before you start your mind wandering. Otherwise the cops or bylaw officers would run out of ticket pads cause that's all they'd be doing all day.

While that may be the case where you live, it is illegal for a minor to smoke where I live.

I think they would apply the "Shoot first and ask questions later", or "If it looks like a duck, quacks like a duck, then it's a duck" attitude! They would not be able to determine if it was 0mg without testing, so a blanket "No Vaping Under 18 Years old" would probably be enforced.

As an ex 2PAD smoker and now a continuous vaper, I would prefer kids not get started at all. Perhaps by keeping vaping as an "adult" activity it may discourage a few from starting.

My two cents - 1/2 cent after taxes!

So if you weigh the same as a duck..............

Based on that theory, all vaporizers should be an illegal sale to a minor, regardless of delivery method.

I'm just saying...currently, e-cigs are considered to be a "tobacco product" by the government. As such, vendors cannot sell to minors. A vaporizer that you buy to, say, humidify a room in your house, is not considered to be a "tobacco product."

It would be nice if we lived in such a black and white world...unfortunately, we do not.

My son has asthma and uses a vaporizer so I guess he should give that up also according to some.

That type of vaporizer is not considered a "tobacco product" by the government. Frankly, it's an apples to oranges comparison...one cannot compare a PV loaded with e-juice to a room vaporizer filled with water or a prescription inhaler.

But it's a vaporizer all the same. Just because a liquid goes into an eGo, it does not have to contain, nor is it a requirement to introduce nicotine. Where a room vaporizer is concerned, liquids other than a prescription medicine can be placed into them, even e-liquid. Only a person's (or government's) perception turns them into "tobacco products". It's a delivery device, and nothing else.

I support teens vaping as a means to quit smoking (if they're smoking). I do not support teens taking up vaping for the fun of it, even if it's 0 nic. It has the potential to serve as a gateway activity. It's legal here for 16+ to possess and smoke, but illegal to buy and illegal for anyone to buy or sell to them. LEO would definitely regard it suspiciously and could detain/ticket/etc if they chose until they verified it was not an illegal substance, whereas they're not even going to look twice at a smoking teen regardless of whether they're under or over 16.

Having said that - Im not so sure o nic vape is really a gateway to nicotine. - having access is not the same as having interest. Those with an interest will find a way regardless of accessability an those without an interest will no engage regardless of easy access.

certainly it is a far more complex issue than simple availability. "gateway" is rather over used and dismisses the simple fact that kids make choices and decisions all by themselves.

To me, the only thing that could maybe be classified as an e-cigarette is a cig-a-like with pre-loaded juice. Something like a Joye eGo Twist does not look like a cigarette, nor does it come pre-loaded with any type juice. Therefore, it is not an e-cig. I'm not advocating that a teen should buy one, but gubment people tend to stick their neck into our business a little too often. And sometimes up our................
