FDA Will the FDA regs apply to orders from overseas?

So if I retype it and reword it, then it would be ok? The information was essentially mine, the only e-mail that was copied was the list of the information, I thought folks should know, what will be asked, I felt I was hoping to help folks...

So please inform me, as to the rule... If I type this allllll out myself, edit it, well the e-mail part, will it be deleted again?

Just wanted to update and summarize my posting:

Ok, so I just got off the phone with DHL.. I had to provide them all my information, this was not the cost of the orders, this was not my blind luck, according to DHL, they and all shippers are now having to comply with FDA regulations applying to any smoking related products, the FDA has a 5 Day hold on the processing to get their information, the 3 Days for customs.

I was told by DHL, that they will be stopping any shipments that indicated that they are smoking related products in any shape or form, and or from companies and or retailers that sell smoking related products, so I guess they have a list. I was also informed that other shippers will or should be falling in line with these regulations

All I have is what they tell me, so time will tell and we will see if anyone else gets caught up in the mess.

I am not making this .... up.... Just happening the way I have laid it out...

The initial contact from DHL required the following:

Please be advised, we require the following to facilitate clearance of your shipment:

1. U.S. Tax ID of importer. (Social Security if individual)
2. Address of importer.
3. Name of importer.
4. Detailed description of contents.
5. Manufacturer name and address.


Please send the requested information to DHL Rep....
Please note, without the above mentioned items your shipment is in danger of returning to the origin on 10-05. We will follow up with you no later than 5pm your time on 09-28


Additionally I had to provide a detailed list of the contents, so I typed it out and sent to them, along with a PDF of the Invoice.

Then they came back asking if there was juice in the order.. .... I told them look at the invoice, crap then I get another call to verify who I am and give them my SS Number again

Then they thanked me and told me the FDA processing will take 5 days and then 3 additional days for customs processing....

Like I said I asked the rep, is this normal, she said no, not in the past, but it will be for any smoking related products, vapes and juices were not considered smoke related, till the FDA designated them as such, and now the shippers have to look for them...

So beware...

Essentially the FDA is going to lock down the borders to the U.S. just as they did with Clove Cigarettes yeas back... When they said that clove cigarettes lead to kids smoking...

And yes this will be applied to anything that could be utilized for vaping... including batteries, drip tips, and such, but it will more than likely be from who and where shipped, I do believe they have a database in place for any vape related retailers, that would be my opinion....

Yes I was trying to get my toys before the end of September, hell I was hounding these guys, I was expecting this, but delays and delays, for all the new fun stuff, I was figuring new tech was going to be dead for some time, so I was stocking up, I have stocked up on coils, wire, cotton, rope, juice, freaking everything, now I am out to build my bomb shelter and install my generator to be able to charge the toys I have....

FastTech labels vape gear as simply, "electronic components" as they do with other items not vape-related. I don't understand how DHL knows what's inside each and every package.

Something doesn't smell right here.

You removed it... The content was not from others, it was mine, I just took my replies, summarized, and put together so I would not have to type it all out again.... I was not using any other persons replies or responses..

I think you should have give me the opportunity to respond before just deleting....

I order all my hardware from FT. When I buy there is no age verification. The package label says "electronic gadget". I did notice I couldn't complete an order that includes battery cells. Apparently there is no shpper willing to bring them to the US in small packages. (That stopped me from ordering a Pico Mega.)

So the FDA could send a letter to FT and say implement age verification, identify ecig products on the package and stop sending new products to the US or else we will...what exactly? If FT ignored those instructions what recourse would the FDA have today? Do they have the authority today to force Customs to intercept all FT shipments and impound them? If yes what are they waiting for?

I order all my hardware from FT. When I buy there is no age verification. The package label says "electronic gadget". I did notice I couldn't complete an order that includes battery cells. Apparently there is no shpper willing to bring them to the US in small packages. (That stopped me from ordering a Pico Mega.)

So the FDA could send a letter to FT and say implement age verification, identify ecig products on the package and stop sending new products to the US or else we will...what exactly? If FT ignored those instructions what recourse would the FDA have today? Do they have the authority today to force Customs to intercept all FT shipments and impound them? If yes what are they waiting for?

The battery thing is because of the no lithium batteries allowed as cargo on airplanes for safety reasons which has been in effect for a while but being more stickly enforced recently.

No, the FDA can't directly require FT to implement age verification or correctly identify whats in packages but they CAN require that all packages that are going to enter the US have the correct paperwork and have verification that the person ordering is of legal age OR, as you asked, the 'what exactly" is that the package can NOT enter the US. If the china vendors did supply paperwork that contained the required information the shipments would still be checked, the same as all shipments entering the US are suppose to be checked ;) and pass through without a problem as long as everything in them was legal to bring into the US and as far as our ecigs go everything is legal right now as long as it was on the market before 8/8/16.

It seems as if at the moment DHL is simply complying more specifically with the rules then other shippers but chances are those other shippers will catch up and follow the rules at some point. I guess the point is, follow the rules and there won't be a problem, don't follow the rules and hold ups and problems will arise.

I paid my dues. I know what I need to know and what I need to do to drop off the radar into the vape wilderness, never to be seen in the market place again for a decade and probably longer. And the whole exercise is a small amount of money for me right now (working 60 hours a week). I hate hate hate buying stuff I don't need. It goes against my stingy Puritan grain. A package comes, it's another mod for the bottom drawer. A quick function test and goodbuy for years to come, sigh. My official mod stash is only 10 peices above what I keep in service. It's very hard to buy them but I'm probably an idiot if it's not done by the end of the year.

Those government guys are siting around in their war room trying to judge how much disruption they can get away with and not have too much backlash. Can't we please send them all back home to Utah and Connecticut. At least the old time snake oil salesmen were colorful.
