You might not see it as the job of an Elected Officials to Regulate things. And in a Happy, Magical, Fantasy Land this might be True. But we don't live in that Land.

I can Guarantee that when people send Cell Phone Photo pictures of this Self-Serve Free Sample display to there City, State and or Federal Reps, that they will Not be Overlooked.


Councilmen cannot enact laws.

I fully understand the legal powers of elected office.
In the United States:
We don't elect people to decide for us, we elect them to represent us and our will.

You really should take a closer look at how out government legally works.

Or that Cities or Counties can not Create Laws or Codes to within their Limits that are not in Conflict with a State or Federal Law/Code?

Try reading my posts instead of changing my words. That isnt what I said at all.

Here, I'll educate you on the process for a city ordinance.

A councilman has to write the proposed ordinance and present it at a council meeting/session, if it gets pushed forward with support, it's discussed publicly usually at a later meeting/session.
If the public agrees, it's voted on.

If the city council tries to enact ordinances contrary to the will of the people they will lose their seats/jobs in the next election.



The point is, this display won't cause civil action like you suggested, but it does pose an obvious health risk

The brand name appears to be "Elektro", just another gas station cigalike ... :(

Their website has a lot of the same rhetoric that will make experienced vapers cringe ...

"This cartridge is where the smoking liquid is held. When you inhale, the battery activates the internal heating element, called a atomizer, and the smoking liquid is vaporized into a flavorful vapor. A cartridge that is pre-filled with smoking liquid and comes with a built-in atomizer is called a cartomizer."

I doubt that the product display was delivered with this "try before you buy" feature, it has the look of something cobbled together from hardware store parts ... :blink:

A flat head screw on a ring terminal. For shame ... :blush:

Someone must be buying this junk. Every convenience store and gas station seems to have a lot of counter and shelf space devoted to cigalikes, and they don't gather dust ... :unsure:

The amount of Public Involvement in Most council actions is about a 1/2 step up from Nothing. So the concept of Public Approval (or Dis-Approval) is theoretically Correct. But in reality, it plays Little in the Decision Making process.

And where the Backlash with something like this Display occurs is in the Way that Ordinances are worded. I can argue that "Free Samples" of e-Liquids should Not Occur within the City I live. And it would be Very Hard to find someone who would Oppose it when I show them the Picture in this Thread.

But when passed, all of a sudden Vapers realize that this New Ordinance now applies to Vape Shops who hand out 3ml "Free Samples" in sealed Bottles for Vaper's to use in their Hardware.

Also, how does something like this Display help Vaper's if for some reason the Public Actually did come to speak at a Council Meeting regarding e-Cigarettes? You mentioned the "will of the people". Are we winning people over to Our Side by Garbage like this?

The California Constitution, Article XI Section 7, gives Counties and Cities the ability to make and enforce within its limits all local, police, sanitary, and other ordinances and regulations not in conflict with general laws. Putting this type of Display in your store is just Asking a County or City to use this power.

City council voted behind closed doors to increase Sewer/water 400%.
(Legally) posted a small, obscure add for topic discussion in the Sunday Paper, and Voted on Monday:blink:
Every single one was still in office next election:rolleyes:
They pull crap like this every few months and the Sheeple pay it on never mind. :shock:

Omg.. reminds me when someone asked me did I use liquid smoke when I cooked a pork roast on the smoker!! Never heard e juice called smoking liquid too funny!

If your local city council doesn't do their jobs why do they still have them?
Obviously they do not fear losing their elected office.

Arguing that you accept your representatives disregarding their sworn office and legal authority, isn't a good position, nor does it invalidate my post.
It also doesn't change the legal limits of their authority or due process.

Unfortunately, things like that Display are perceived by the Average Person as a "We" thing. And not just a Misguided Abomination of what One Person who thought was a Good Idea.

Hey don't get me Wrong.

I would Love it if when a ANTZ Media Outlet ran a story showing something like that Display that they would Also say that they went to 99 other Vape Shops and never saw anything like that. But they Don't.

Just like I would also Love it if the City, County, State, and Federal Policy and Law/Code making process was Fair, Honest and Transparent. But in Isn't.

What gets to me is the fact that anyone would have to regulate something like this. I figure if someone is actually foolish enough to do it, they pretty well deserve what they get.
That's the plan,the shop owner is actually an anti vape activist,so they are trying to wipe the new vapors out before they get a chance to spread haha.
