I’ve seen some news about large-scale seizures and stricter checks, so I wanted to share the latest info I found and ask if anyone here has experienced delayed or seized shipments lately?
From the latest official updates and enforcement actions (as of late 2025):
1. Strict enforcement on unauthorized products: Since January 3, 2025, the FDA has updated import alerts to clarify that all unauthorized e-cigarettes (including disposables) can be detained without physical examination and refused entry into the US. This means if your disposable vapes haven’t obtained FDA’s Premarket Tobacco Product Application (PMTA) authorization and STN code, they’re likely to be seized once inspected.
2. Large-scale seizures of Chinese shipments: CBP and FDA have carried out multiple joint operations this year, seizing massive amounts of illegal disposable vapes from China. The biggest operation in Chicago in September seized 4.7 million units worth over $86.5 million, and another in Minneapolis seized 90,000 disposables plus 75,000 cartridges in late September. Even as recently as November 6, Chicago CBP seized 43,200 Kangvape Onee Stick disposables from China, which lacked PMTA authorization and were undervalued to evade duties.
3. Key reasons for seizures: Most seized disposable vapes violate the Federal Food, Drug, and Cosmetic Act—they lack mandatory FDA marketing authorization, are adulterated, misbranded, or falsely declared/undervalued to avoid inspections and tariffs. So even if your shipment is declared correctly, it may be seized if it’s not PMTA-compliant.
4. Tariff and compliance notes: For legally authorized disposables (only 39 products approved by FDA so far), the tariff classification is 8543.40.0040 with a 2.6% ad valorem duty. But most disposable vapes on the market haven’t passed PMTA (pass rate is extremely low, nearly 99.99%), making them illegal to import.
