I would have thought that They would have been Out In Front and would be Burning Down the Forums/Blogs with Statements.

Seeing that Each of their Members, who paid Big Bucks to become a member, stands to Suffer the Largest Monetary Loss.
Well, Lou Ritter and Linc Williams both asked questions during the FDA/Mitch Zeller teleconference.
So they are definitely monitoring the situation closely.

But I share your curiosity as to what their thoughts are.

It is so hard to oppose the underage sales of PV's! I would rather see a teenager vape than smoke, but I would hate to see pre teens walking around, openly puffing away.

We are approaching the 5-10 year vaping mark, and the only thing detrimental I have seen with vaping is user error, and pure stupidity (letting small children getting ahold of e liquid). Otherwise, I have heard nothing else. I said it before, I'll say it again, we need to get physicians in on this. We need to strike up conversations with our doctors about these regulations, especially those of us who have smoking related conditions like emphysema, COPD, bronchitis, and have had doctors that have monitored progress since the vaping started. We know there are doctors on our side, and they need to speak up!

It would take a congressman less that 90 seconds to write a bill that would resolve that probblem, and it would only take congress about 10 minutes to debate and pass it. ............. but, that's to easy, they would much rather use it as a pawn to get less popular ideas passed.

    Tell me about it!

But it is actually very easy to not favor such a ban. To not vocalize, "yeah, I think a ban against minors is a good thing." Heck just typing that in quotes makes me shudder. Most of time, I just stay silent on the topic, realizing I'm outnumbered 99 to 1.

In this case though, I see it driving all other proposed regulations and see people vocalizing their okay for such a policy. So, for the short while that this comment period is around, I may not be shy on this point.

But if you think about what young teen smokers (discounting 17&18 year olds) did to put a rush on smoking bans, and face it, teens were NOT the most courteous of smokers! And yes, I am almost 40 years old, so I was a teenager when places were banning privately, so I can see them doing the same to vaping. For example, can you see a junior high school allowing kids to vape, "cloud chucking" contests, rebuilding their atties in the middle of Social Studies and leaving the mess, or wiping it onto the floor, dumping juice and not cleaning it up, tossing cartomizers and heads onto the floor, or flushing them down the toilets?

If the FDA didn't put a restriction on kids, lawmakers sure would. That part is inevitable. But that shouldn't affect adults, unless we get some careless ones.

I don't know if this will be something you would like to use, but here it is...
    https://drive.google.com/file/d/0B01zUk1aSNToRTVISXMzTTExU2s/edit?usp=sharing

I'm going to seek opinions before doing so...

But I am tentatively planning on handing that out to all local vendors at the very least.
And including with it a whole bunch of copies of CASAA Call to Action when it is released.

I think providing the numbers ($$$) to the vendor's cost to stay in business would be an eye-opener. From the Economic Impact Analysis document, it appears the FDA is estimating $6.6M - $26M per supplier.

    holy mackerel.
Looks like the FDA just got itself a license to print money (as we say in German).

The real problem is that $26m wouldn't allow enough products for a vendor to keep their doors open.

I doubt there'll be any eliquid vendors left. 99% of eliquid vendors started out using most of their own savings for start up. Even if they were lucky enough to clear a million dollars their first year of business, its not enough. It's going to cost more than that for 1 product. These regulations were designed for big tobacco where there's hundreds of millions of dollars for applications. The FDA knows this, but they don't care. They know this will cripple the eliquid market into nonexistence. There's a slight Chance 1 or 2 vendors may be able to get the money for 1 or 2 flavors applications. Sadly even with applications and fees paid there's still no guarantee they'd approve any flavors. The FDA has only approved 2 new tobacco products out of thousands in the past few years. Plus, they've publicly stated their views on flavors. They denied a new tobacco product a couple of years back for adding one flavor. Our chances of getting flavored eliquids into the market after these regulations go through is slim to done.

Unless we can fight these regulations as they are written now our future of eliquids and products will be limited to almost nothing except what big tobacco throws out.

And after drummerskey's OP, there is still some bickering going on here. How about discussing work-arounds, after all, these regulations are not law yet, and someone is going to fight it in court. I may be looking at this with rose colored glasses, but I just hope there is some good left somewhere in this country.

It just seems Strange that we Reach the Epoch that Every e-Cigarette user has Feared (but knew would happen) and there Doesn't seem to be much of a Response from the Trade Organizations or OEM's.

Seems like there is More Talk about the Possibility that Reynolds may seek to acquire Lorillard/Blu.

The problem is that the FDA has written these regulations where there is no room for work arounds. Our only recourse is to fight the regulations before they get passed through.

Isn't that were the Lawyers need to come in?

And to bring Suit that the FDA is Unreasonably Restricting a Market? And that it can Not be shown that e-Cigarette/e-Liquid use will be "Safer" or that less Minors will use an e-Cigarette because of it?

Since ECF is not a Trade organization forum, it's irrelevant. Since this is a consumer driven forum, it seems Prudent  that we concentrate on what we as consumers can most effectively do to keep vaping available in multiple forms.

Those on ECF who are Against encouraging all vapers to join and support CASAA, the only consumer driven vaping non-profit organization, but instead lament Trade organization inaction, are not supporting a viable alternative for vaping Consumers.

The problem with this is you can't even start a litigation until a product has been denied. So, these regulations will be law by then. All we can do is fight with the FDA on these regulations now and hope we can sway them.

If you think that the e-Liquid Trade Organizations are Irrelevant, or that their Motivation to Influence FDA Policy does Not Effect ALL e-Cigarette Users, then you are Mistaken.

Like it or Not, these Trade Organizations have a Direct Connection with the FDA. And Ignoring them is akin to Sticking your Head In The Sand.

From the people I have spoken to, they seem to think that there are Valid legal grounds to pursue actions against the FDA.

But I will preface this by saying that they are Lawyers. And Lawyers ALLWAYS believe that there are Viable Legal Options.
