A fact: One that I dislike very much. :( I performed an admission of a patient last week. I was distraught because I had to get a signature on a no-tobacco usage. I actually read this document that was dated Jan 1, 2014. In the document it stated the use of electronic cigarettes was considered tobacco. Really?

I suppose I will get into trouble because I will let my patients vape if they want to. According to this document they have to go off-site to smoke a cigarette or a ecig aka a vaporizer. Nonsense!

Many hospitals and companies are now taking this approach. I recently received an e-mail stating that our HR department "makes no distinction between electronic or conventional cigarettes for the purposes of these guidelines."

Hospitals in Florida are charging employees who vape the same premiums that they charge cigarette smokers for health insurance, an average of $100-200 a month.
Same in WI. DH insurance announced this year that the electronic cigarette was considered a tobacco product. They will be doing random nicotine testing on all employees.

In 2009, the Family Smoking Prevention and Tobacco Control Act was signed into law. The cornerstone of this legislation involved granting the FDA authority to regulate the manufacture, distribution and marketing of "tobacco products". Between 2008 and 2010, the FDA attempted to regulate e-cigarettes as an unapproved drug/device and as a result, prevented the import of certain e-cig brands.

The companies affected by this sued the FDA, and won on the grounds that e-cigarettes are not drugs/devices unless they're marketed for "therapeutic purposes". This is why e-cig companies do not, and cannot market their products as a quit smoking aid

April 2009: Smoking Everywhere files a federal complaint seeking an injunction against the FDA with respect to the FDA's attempts to ban the import of Electronic Cigarettes. Smoking Everywhere contends that the FDA has no authority over electronic cigarettes, as they are a "tobacco product" and the FDA's attempt to regulate them infringes on Congress's intent to withhold FDA jurisdiction over tobacco products. They contend that electronic cigarettes are not "drugs," "drug delivery systems," or "drug device combinations" under 21 U.S.C 321(g).

The ECA (now defunct) is a trade association made up of electronic cigarette producers, distributors and retailers; whose aim is to speak on behalf of the electronic cigarette industry, especially in response to health concerns, and to help institute industry standards. The group is headquartered in Washington, D.C. Its president and spokesman is former United States congressman Matt Salmon.

Florida hospitals are now screening new and potential employees for the presence of cotinine, a metabolite of nicotine, in an attempt to wean smokers out of the potential hiring pool so that they do not have to cover them with health insurance.

I pay an extra $15 a month for health insurance and $12 a month for life insurance. They check for nicotine. So, even though I don't smoke cigarettes, or face the same health risks, I pay almost $300 a year in penalties.

May 2009: FDA tests 2 brands of electronic cigarettes, NJOY & Smoking Everywhere. 18 cartridges are tested. Tests reveal trace amounts of tobacco-specific nitrosamines (TSNAs) in the liquid in levels comparable to those found in FDA-approved nicotine cessation products. The liquid of one cartridge is found to contain a non-toxic amount (approximately 1%) diethylene glycol. TSNAs nor diethylene glycol is detected in the vapor. Some cartridges labeled as 0mg nicotine are shown to contain trace amounts of nicotine.

There are some employees in a central Florida hospital (can't say which one as I still have professional ties there) who are filing a class action lawsuit for discrimination, because obese employees, who are at least the same if not higher health risk, are not being charged extra premiums.

June 2009: President Obama signs into law the Family Smoking Prevention and Tobacco Control Act 18, giving the FDA the power to regulate the tobacco industry. Although nicotine and cigarettes as a whole cannot be banned outright, flavoring such as fruit or mint can. Additionally, new tobacco products seeking to enter the market will be required to meet FDA pre-market standards, which could affect electronic cigarette regulation.

Fact: MOV has been on my must order list since I first heard of them on the natural tobacco part deux thread. Sunday Morning's blend of coffee and pipe tobacco is right up my alley.

The first known person on record to have the idea for an electronic smoking device was Herbert A. Gilbert. In 1963, he filed a patent for this type of product, being entirely ahead of his time in more ways than one. He was well aware of the hazards of tobacco.

But sadly, an idea was simply not enough at that time. During this era, cigarettes were so common and so well accepted in our society that using them in public places was entirely ordinary. At the office, in university classrooms, airplanes, and just about everywhere, smoking was common, and was not considered healthy or dangerous in any way.

There just was not a market for a healthier alternative to cigarettes, and the technology was also lacking.
