FDA Regulations Will Finally Begin
It seems like the world has waited for years to see how the FDA would handle e-cigarettes, but 2014 will most likely be the year when official regulation begins. One ecig blogger predicted that the FDA would implement new regulations, but most of the legislation would be up to individual cities or states. “The FDA will release something, though it seems like they might be leaning on states to do their dirty work with support form the CDC. I expect the American battle to be mostly a battle of attrition that happens at the state and city level. It will be a matter of endurance to see which side can keep fielding activists to attend meetings and lobby politician

y 2009: FDA files a supplemental brief in the Smoking Everywhere lawsuit referencing the Family Smoking Prevention and tobacco Control Act. The FDA contends that it still has authority over electronic cigarettes and FDA stand behind the decision to label it a drug-device combination. "FDA found, after examining the product, the claims made in the product labeling, and information SE submitted to FDA, that SE's product met the definition of both a drug and device under the FDCA.

2009: Two months after testing, the FDA issues a press release discouraging the use of electronic cigarettes and repeating previously stated concerns that electronic cigarettes may be marketed to young people, lack appropriate health warnings and that they contain carcinogens and toxic chemicals such as diethylene glycol, an ingredient used in antifreeze. The FDA did not reveal that the carcinogens found were similar to those found at the same levels in FDA-approved nicotine cessation products, nor that the amount of diethylene glycol found would not be toxic. The FDA also did not disclose that neither substance was found in the actual vapor to which the user is exposed.

FDA regulations to look forward to according to Walt from Killer Juice.

So I had an interesting meeting with my FDA contact. Looks like the rules will be super loose but they are planning to make the retail side a lot stricter. Not so much the manufacturing side. He did not know exactly what would be on the recommendations but told me not to worry to much because they will be no worse than our current ones are. (Remember we are already regulated by the FDA for our other uses of flavors, I have to submit paperwork and all kinds of fun stuff weekly. While the inspection is only 2 years, they require really good records. Due to the upcoming rulings and recommendations we are going to start making some changes to our site and our labels. While this may not effect a lot of people these are important changes. Some will not come right away either.

1. Full ingredients list on all labels. Honestly it does not sound like much but we want to be clear on what you are vaping.

2. Tamper-proofing all bottles. While the bulk bottles are currently no we will work to change this. The glass will soon be heat sealed.

3. Age verification on the website. We will only allow shipping to the billing name on a credit card, or debit card. No longer can they be different names.

4. Age verification II - All packages are going to start requiring a signature. To sign for it you will have to be 18. We are working with USPS, and UPS to allow you to OK and sign for a package online where you would not have to be present for all the people who work all day.

More are planned but we want to get a start on these. REMEMBER these are not all taking effect today. This is just a heads up about what is coming.

2009: FDA's May 2009 study is reviewed by scientific consulting firm Exponent, Inc., in a report commissioned by NJOY. Some of the criticisms of the FDA study, as set forth in Exponent's report, are poor standards of documentation and analysis and failure to perform relevant comparisons to FDA-approved nicotine replacement therapy products, which Exponent claims contain TSNA levels comparable to those of electronic cigarettes. The study concludes that the FDA's claims of potential adverse health effects were not supported by the study.

Because they contain no tobacco, e-cigarettes aren't subject to U.S. tobacco laws, which means they can be purchased without proof of age, especially online. This raises concerns that e-cigs may be particularly appealing to kids and may encourage nicotine addiction among young people. And while manufacturers of the e-cigarette claim that it's the cigarette you can "smoke" anywhere, regulatory agencies around the world are taking a close look at these gadgets and instituting a range of restrictions on their use.

Lies the FDA tells.

the potential risks of e-cigarettes when used as intended,
how much nicotine or other potentially harmful chemicals are being inhaled during use, or
if there are any benefits associated with using these products.
Additionally, it is not known if e-cigarettes may lead young people to try other tobacco products, including conventional cigarettes, which are known to cause disease and lead to premature death.

The FDA also lists health risks of e-cigarettes in a misleading way.

We regularly receive voluntary reports1 of adverse events involving e-cigarettes from consumers, health professionals and concerned members of the public. The adverse events described in these reports include hospitalization for illnesses such as

pneumonia,
congestive heart failure,
disorientation,
seizure,
hypotension, and
other health problems.
Whether e-cigarettes caused these reported adverse events is unknown. Some of the adverse events could be related to a pre-existing medical condition or to other causes that were not reported to FDA. You can review the adverse event reports for e-cigarettes4 that were voluntarily reported to FDA from 6/22/2009 to 10/5/13 at the CTP FOIA Electronic Reading Room.

We have no clue if these were related to e-cigs, but we'll scare you and poison the well anyway. Such tactics wouldn't even be allowed in a high school debate club.

2009: In a Washington Times op-ed, Dr. Elizabeth Whelan, president of the American Council on Science and Health, calls the FDA press statement about electronic cigarettes "distorted, incomplete and misleading" and meant to "scare Americans" to stay "away from these newfangled, untested cigarette substitutes -- better to stick with the real ones."

Most Americans support letting people vape in public.

The new Reason-Rupe poll finds that 62 percent of Americans think the government should allow people to use tobacco-free electronic cigarettes in public places while 34 percent say the government should prohibit this activity.

Non-partisan independents (66 percent) and independents who lean Republican (68 percent) are more likely than Democrats (58 percent) to think government should allow people to use e-cigarettes in public places. Nevertheless, majorities of all political groups think electronic cigarettes should be allowed, including 63 percent of Republicans and 61 percent of Independents who lean Democratic.

Self-identified libertarians are 22 points more likely than self-identified liberals to say the government should allow this activity (77 percent to 55 percent).

2009: The State of Oregon files two settlements that prevent two national travel store chains, Pilot Travel Centers and TA Operating, from selling NJOY electronic cigarettes. In addition, the company must give the Attorney General advance notice that they intend to sell electronic cigarettes in Oregon, provide copies of all electronic cigarette advertising, and provide copies of the scientific studies they maintain substantiates their claims. NJOY voluntarily stops all sales in Oregon.

Facts on inhalation technique

With these differences in mind there is a particular technique that users should try to develop to have a satisfying vaping experience:

Draw (ie drag or pull) very, very lightly in comparison to a cigarette.
Pull the vapor into the mouth, not the lungs.
Draw for an extended length of time – for at least 3 seconds. This because for a 1-second draw, the atomizer does not heat up fully, and also because there is not as much nicotine in the vapor as in cigarette smoke.
Hold the vapor in the mouth for 2 seconds, then inhale, then exhale very slowly through the nose.
If you have trouble doing a long pull with just the mouth, then draw using the mouth only for one pull, using the lungs for the next.
Use the ecigarette for twice as long as a tobacco cigarette lasts you.
Experienced users, using a small-format standard ecigarette model, often use a highly extended drag in order to get sufficient hit: they draw (lightly) for 6 or 8 seconds. When you try this for the first time, you will realise that proper e-cigarette completely changes the experience.
