I'm sure we've all seen an episode of cops on T.V. before and I don't know if the bill coming into CA will ban use and posession of ecigs, but I know that it will ban the sale of them.

I was thinking that I don't want to be on the next episode of Cops. You see all those people who get pulled over for some minor moving violation and then they are being hauled off to jail for having drug paraphernalia.

Cop: Don't you have anything in the car I should know about?

Citizen: Just my ecig, and some juice.

Cop: Please step out of the car slowly and put your hand behind you back.

That may be an over damatization...but would if you were going on a road trip and you were driving in CA and you wanted to make sure you had enough supplies for your trip. Then you get pulled over and they find bottles of juice and ecig accessories. When the new bill takes effect...could they arrest you for intent to sale?

That may be over dramatic too but it's a scary thought.

I seriously doubt it. If it's all for your personal use then they have no grounds to arrest you. In fact, if they DID arrest you, you could sue them.

What if I'm driving with a carton of Djarums in my car. Can the cops arrest me? Of course not. Same difference.

This is semi-off topic, however one of the best ways to avoid the situation you are talking about is to know your rights when dealing with the police, and use them.

I never thought about that. LOL Being out of touch, I would never have known if the ban came down while we were road tripping.
We were just on vacation to Nevada, Utah, Colorado, Wyoming and So Dakota. Husband got a ticket in a speed trap in Utah (watch for speed limit signs in Hurricane!).
My passthrough was hooked up, I had +40 ml of liquid in about 7 bottles in assorted flavors and levels, all my PVs & parts, at least 2 chargers for each of my PV models in an aluminum case on the back seat of the car (my failure phobia is showing).
THAT could have been a very interesting conversation if the cop had noticed the case and questioned us. In fact, when I think about it I'm surprised he didn't notice it because it looks like a padded hand gun case. 8-o

Its funny I was going to say the same thing. I've seen those videos and they are absolutely true. You should know you rights and never admit to anything. Never consent to any searches, even if you don't have anything to hide. Never let yourself be intimidated by police. Police intimidation runs rampant in NJ

Djarums are cloves, which have been banned for sale in the US by the recent "anti-flavoured tobacco" bill. they will be under the exact same law as ecigs - you can own, use, eat, whatever.. them.. but you cant sell them.

I wouldn't worry about that now, they're perfectly legal for the time being.

In the future? Just get one of those ecigs that looks like a cigarette, that's what i'm gonna do. Then you'll just look like you're consuming large amounts of toxic, carcinogenic cigarette smoke-- perfectly legal

I just bought a pack a a little under a week ago. Djarums are now sold as Filtered Clove Cigars. It states this on the pack. I bought Djarum Blacks.

Don't be unless you have something else in your car that is not legal. I use a silver bullet in my car. A cop pulled up right next to me, and I continued to use it. Not sure if he saw it or not.

I don't think they can fine/arrest you unless you actually sell it. They may be able to on intent, but proving this would be difficult. It is not the same as if I came to Cali with 100lb of pot. There is a clear intent to sell as this amount is certainly not for personal use. I think you would have to have 1000's of parts and gallons of juice before they could prove intent.

I did not see anything in SB-400 about importation. If there is then you may be in a bit of trouble for bringing it into the state.

In any case I am not a lawyer. Sun would be the best person to ask about this.

Are you living in an area where you might be pulled over for your windows being too dark? I got a used car with tinted windows, and i got pulled over twice within a year before removing the tint!

I would be wary about being pulled over for any reason if i have something sitting in my car that they might confiscate.

I've had my windows tinted for years on all my cars and have never been pulled over for it... and I don't carry anything in my car that could get me in trouble. Just where I live not too many people know what an e-cigarette is. I get lots of stares.

In California you can purchase medical marijuana. If they stop you for any reason you can be charged with drug possesion unless you have a card stating this is for medical purposes. I guess the same thing could happen if you are stopped and have in your possesion an electronic cigarette especially if you have enough with the intent to sell. I wonder what laws you have broken with this one. It will really be a joke.

And the crazy part is that anybody can get a medical marijuana license. My friend wanted to be able to smoke legally so he got one here in California. All it takes is money and knowing the right "doctors."

Well, my question is, why would you give the cop "permission" to search your car anyway?
If you are stopped for commiting a crime, ie: speeding, turn signal, whatever. DO NOT give the cop permission to search your car, he is looking for evidence to charge you with a more serious crime.
If he starts that crap of "why won't you let me look in your car, do you have something you don't want me to see?" Just say no, do you have any reason to suspect a crime is being commited? or how about, no, but i do want you to see and acknowledge my right to protect myself from unreasonable search and seizure.
I carry a gun, licensed to of course, but in my state i don't even have to tell the officer that i have one, unless he asks.
End thought, do not help the officer put you in jail or seize your belongings.

Also a must watch is How To Refuse A Police Search . I know of theses videos because of the many GUN owner forums I belong to and the videos go over YOUR RIGHTS ! Not just your rights about owning guns and carrying guns. But YOUR RIGHTS as stated in the bill of rights. You should know them and know how to protect yourself. If you don't know your rights how do you expect to keep them.

I carry a Walther P99 9mm hand gun And a Joye 510 E-Cig. Get use to seeing me with them because there mine and I will carry them with pride where ever I go ! And I open carry my fire arms because my state laws say that is my Right , I do the same with my 510 untill such a time the law tells me I can't. ( God Forbid )
