Ebay now removing E cigs.

Just received an email that says my listing has been removed.


"you recently listed the following Fixed Price listing:

270331572358 - Electronic Cigarette DSE901 ULTIMATE Starter Kit


Unfortunately, we had to remove your listing because the following information violates our policy:

Because of various regulatory issues, cigarettes, cigars, and smokeless tobacco products are not allowed on eBay.





We notified members who placed bids on the item that the listing has been canceled.

eBay does not permit listings for most alcoholic beverages and tobacco products on our U.S. Web site. This includes cigarettes, cigars, and smokeless tobacco. In addition, non-U.S. members are not allowed to sell alcohol to an eBay member who is located in the United States.

However, listings for some tobacco- or alcohol-related collectibles, such as packaging, containers, and other memorabilia, are permitted on eBay under certain conditions. We understand that some unopened tobacco products may be considered collectible. Sellers are permitted to list these types of items, even if they contain a real tobacco product, under the following conditions and as long as the item description contains the following statements:

Conditions:
- Sellers must take steps to ensure that the buyer is at least 18 years old.
- Buyers and sellers are responsible for ensuring that any transaction involving tobacco complies with all applicable laws and shipping regulations.

Statements:
- Bidders must be at least 18 years old.
- The package has not been opened, but the product within is not for consumption.
- The seller will ensure that the sale complies with all applicable laws and shipping regulations.
- The value of the item is in the collectible packaging, not in the tobacco itself.
- The collectible tobacco packaging is not available at any retail outlet.
- The value of the packaging is substantially greater than the current retail price of the tobacco product in the package.

Strange--I did not know e-cigs containted tobacco?? "eBay does not permit listings for most alcoholic beverages and tobacco products on our U.S. Web site. I have a feeling they consider nicotine a derivative of tobacco (which it is) and this would fall under smokeless tobacco.

Please dont let this happen without a fight .... bombard e-bay asking why, preferably by phone etc emails are easy to ignore these days. Present the facts , there is NO tobacco , therefore by their current rules it is not in violation. if you can head off the ebay issue, you are one step closer to getting legitimacy, not a big one , but each step counts... You can guarantee the powers that be will use e-bay as an example of private industry already supporting whatever they have planned... something like e-bay is a huge player in public awareness and distribution.e-cigs here in Australia were only pulled by e-bay AFTER the ban... Methinks there may be some pro-active lobbying by those who want you illegal that has been presented to ebay , ebay is usually only pro-active in such matters when they are pushed by someone with some clout !!!

Guess ya can't sell eJuice or even juice recipes there either, I just got this email from eBay about a recipie I bought there recently.......

I just checked e-bay and emailed a few people I know who have been selling on there since 1998. They made inquiry and the response was that they have not heard of any problems and there are currently 630 e-cigs for sale there. Also one member made inquiry to e-bay and said the e-cig does not fall in their banned catagory---So I do not know what happened in your case:confused:

Thought it was funny but now it seems they are taking this approach to vaping :(
