FDA Deeming - Just Some General Questions

Hi everyone! Fell off the wagon for a while, hopped back on (holding on tight), and now I'm learning about all of this FDA stuff. I've been lurking around, reading articles that others have posted, and reading through some big posts about it. I just want to make sure what I'm reading is actually registering appropriately in my head (honestly, I keep reading vague articles, so I'm not sure I'm getting BIG PICTURE here).

So, August 8th, 2016, deeming goes into effect? Do things go flying off the shelves at this time? And companies must submit applications on their products, their safety, why they should stay on the market, etc? And each costs a ridiculous amount of money... those companies and small b&m's that make their own juices... if they can't afford the price tag of the app, do they have to shut down their juice-making operation as of August 8th? And this application thing is a 2 year process, right?

If anyone has a good in depth article that explains the steps behind vapocalypse, that'd be great, too!

Or, to save you from 574 pages, as of 8/8, no new stuff can be released without FDA review and approval. Within 2 years, anything that wants to continue to be sold must file an application, and may continue to sell for another 12 months, or their application is denied.

That's a really broad stroke. There's other stuff, some of which might matter to you (or not) such as age restrictions, limitations on advertising , and required labeling that will go into effect as of 8/8.

We are not quite sure how bad it will get on 8-8-16 by each state. Since vape products are being deemed tobacco products on 8-8-16 look up you state laws on tobacco, online sales, taxes on tobacco, etc.

to be safe, stock up now:
Several mods that take replaceable batteries (regulated and mech's), several rebuildable RBA's and or RTA's. Supplies to DIY your own juice, nic base etc. Better safe than sorry because states can do so many things on taxing and no online sales besides what the FDA has done, we really don't know what to expect.

Thanks so much for all of the info, guys! :) So, let me ask another question (or 2), if my little vapor shop down the street, who makes the only juice I absolutely love, can't submit an application on 8/8 due to cost, even though their juices have been on the market for the past couple of years, they can't sell?

As far as other manufacturers and vape shops that can feasibly afford the application, they can still sell their products after the 12 months of their application is up, so long as they are approved within that 12 month time period?

As far as I know, I haven't seen anything specifically different in TN. Our organization here, TSFA, is trying to rally against the federal portion, of course.

I have stocked up on regulated mods (istick 30w - 2 of them, kanger aerotank 2 - 2 of them, 40 coils, and 5 4oz bottles of my favorite juice. This is my setup now, and I am comfortable with it. But tell me if there's a flaw in my plan. I'm not yet ready for rebuilding and DIY juice. I don't trust myself with it yet).

If they are mixing it there, in the shop, I doubt they will be able to continue after 8/8/2016 though it may be awhile before enforcement catches up to every local shop. They'll have to submit the PMTA application by 8/2018 and it's unlikely any liquids will get approved, but there is more to it than that. They'll have to register their products, the facilities have to be up to FDA standards, and their product has to be verifiable as being exactly the same as what was for sale prior to 8/8/2016, and I mean EXACTLY.

Brittlebynature, you seem more optimistic than I and many others are. This isn't a bad thing, it just causes me a bit of concern. If you only hobby vape, then maybe 40 coils and 5 4oz bottles are enough. That is, if you're okay with your hobby coming to an eventual end. That said-

I SO sincerely feel you regarding your lack of readiness to rebuild coils and DIY juice. I'm right there with you. Still, I am reading up on it like crazy and budgeting to buy the things I need in order to do these thing I'm currently uncomfortable doing. I encourage you to consider doing the same. If you do searches here on the forum, every single question you have can be answered. Of course there may be more nuanced questions you'd like to ask, but there are so many great people here that you will feel stronger about doing this in no time.

I'm more confident this week than I was last week, and if that's true of me, I know it will be true of you too. I think I could rebuild a coil now and not make a mess of things (coiler jig on it's way- we'll find out soon!), so I'll be trying that out in a few weeks. I'll be buying a couple of liters of nicotine as well, but those I'll be storing in the freezer. Making e-liquids will the last thing on my list because POISON. Funny/not funny! :eek:)

Glinda, I think my general nature (no pun intended, haha!) is hopelessly optimistic. Lol. That being said, I do intend on buying more stuff the closer we get. Cash flow is an obvious barrier. I want to buy more coils because, hey, you get a dud every once in a while. And I want to buy more juice than I think I would actually use because I will probably use more than I "ration" myself for.

I've thought about just buying the stuff to rebuild coils and DIYing my juice in case I decide to go that route and buying a couple of mods compatible for both pre-built and RBA.

It's a matter of balancing funds I have up until 8/8 and what I think I'll want to delve into later on. Or do I want to try to taper myself off vaping at a certain point down the road? Not a thought I want to put a lot of stock into yet, but it may become a reality. At least if I can prepare myself for those days to come, I might be alright with a finite amount of resources.

You've both got a leg up on the vast majority of vapers, unfortunately. You're aware of the deeming and you know about this place. No one really knows what it will be like the next two years, but we know it won't be the same as it is now, and at least you won't be completely blind sided.

BotherBob, Firefox tells me that link is a "phishing attempt."

I had the same issue yesterday when he posted that link, chrome and my antivirus both gave me a warning saying Dangerous and my antivirus - has confirmed this site can transmit malicious malware or has been involved in online scams or fraud.


personally I think the links should be broken
